THE CORPORATION OF THE
TOWN OF NEUCASTLE
BY-LAW NO. 75-99
a by-law providing for the payment of
parking penalties out of court
WHEREAS under Section 354 (1) 107 (A) of the Municipal
Act, it is provided that Councils of Cities, Towns, Villages,
Police Villages and Townships may pass By-laws, providing for
the voluntary payment of penalties out of court, for the contra-
vention of the parking provisions of a By-law,
AND WHEREAS the Council of the Town of Ne\!castle deems it
expedient to provide for the use of parking tickets,
NOW THEREFORE the Council of the Town of Newcastle
ENACTS AS FOLLOWS:
1.
Where a vehicle is found parked in contravention of the
parking provisions of By-laws of the Former Police Village
of Orono and the former Village of Newcastle, the Parking
Enforcement Officer so finding the vehicle shall attach to
the vehicle a parking ticket in the form of a serially
numbered notice stating,

(a) the permit number and the concise description of the
vehicle.
(b) that the vehicle is unlawfully parked.
(c) the date, time and place of the alleged offence.
(d) that the criver thereof may make voluntary payment
of the penalty within two days, exclusive of
Saturdays, Sundays and Holidays, after the day when
the ticket is attached to make a voluntary payment of
the penalty during regular business hours at the
following Offices:
Hydro-Electric Commission - Main St. Orono
Public Utilites Commission - King St. Newcastle
Bowmanville Town Hall - 40 Temperance St. Bowmanville.
(e) that in the event of failure to so report and make
such payment, a summons will be issued under the
Summary Convictions Act.

The parking ticket shall be prepared in triplicate and the
Parking Enforcement Officer shall attach one copy to the
vehicle and deliver the other copies to the Town Hall in
Bowmanville.

3.
That payment within two days, exclusive of Saturdays,
Sundays, and holidays, after the day when the ticket is
attached to the vehicle, be made at the Office as provided
in Clause l(d) of this By-law, in the sum of one Dollar
which shall be accepted as the payment of a penalty in
full satisfaction in respect of the alleged offence. and
a receipt therefor shall be given to the person making the
payment.
4.
If the payment is not voluntarily made in accordance with
the procedure provided in Sections 1 to 3, the procedure
of the Slunmary Convictions Act and the penalties provided
in the By-laws alleged to have been contravened shall
apply.

By-law #4 of the Police Village of Orono is hereby repealed.
