THE CORPORATION OF THE TOWN OF NEWCASTLE
BY-LAW NO. 75-86.
A by-law to permit the owner of land, abutting a oertain
portion of Waverley Road, Bowmanville, as diverted by the
Ministry of Transportation and Communioations, to construot
a boulevard.

~AR Seotion 453, s.s.(i), Chapter 284, R.S.O. 1970, provides that
By-laws ma;y be passed by the Counoil of every Munioipali ty for pe1'lDi tting
the owners of land abutting on a hi~ to oonstruot, make and maintain
at their own expense, boulevards on that part of the high'w'q that mq be
set aside for that purpose, but not so as to unreasonably confine, impede
or inoommode public traffio and
WR'MRJi!4.S Mr. Milton BrUoe of 7 Coleman Street, Bowmanville, has requested
permission to establish a boulevard on that part of the untravelled
portion of Waverley Road, as diverted, abutting to the rear of his
property;
NOW THEREFORE the Counoil of The Town of IlTewcastle hereby enacts as
follows:
1) That the said Mil ton Bruoe or the owner or oocupant from time to
time of the residential property being # 7 Coleman Street, Bowmanville,
be permitted to oonstruot, make and maintain, at the owner's or
oocupant's expense, a boulevard on that ps.rt of the untravelled
portion of Waverley Road, Bowmanville, as diverted, and abutting
to the rear lot line of the said property and more partioularly
desoribed as Part A on Schedule B attached hereto and foI.'ming part
of this By-law. Said part A being a parcel of land 30.52 feet in

depth and extending across the rear lot line of the property now
owned and oooupied by the said Mr. Bruoe.
2) That the said Mr. Bruoe or the owner or oocupant from time to
time of the residential property being 11 7 Coleman Street, Bowmanvil1e,
be permitted to ereot a ohain link fenoe not more thail 42" in height
around the perimeter of the said lands.
3) Notwithstanding the foregoing, The Counoil of The Town or Newoastle
IIlS\V, when deemed neoessary and upon giving a three (3) months
written notioe to the owners or oocupiers of the residential
property being # 7 Coleman Street, Bowmanville, repeaJ. this By-law.
4) Upon repeal of this By-law, The Town of Newoastle shaJ.l not be
required to oompensate the owner or oocupier or the said lands
for any loss that might be in~ed as a result of repeaJ.1ng
this By-law.
