Being a by-IaY1 to permit the oymer and occupant
of a portion of a building or erection that
encroaches upon the public highway to maintain
and use the same.
WHEREAS Harry Moroz has represented to the Council of the TOlqn of Newcastle
that a portion of a one and one half storey frame building on First Street in the
Town of Newcastle was so erected that by inadvertence it encroaches upon First
Street to the extent of 5 inches more or less as shown on the Plan of Survey by
Donevan & Fleischmann dated March 26, 1969 bearing their job number 17619 attached
as Schedule "A" to this by-law;
AND WHEREAS the Council has agreed to permit the owners and occupants thereof
to maintain and use the said encroachment;
NOW THEREFORE, be it enacted and it is hereby enacted as a by-law' of The
Corporation of the Town of Newcastle by the Council thereof as follows:
1.
The owners and occupant::; of the building shmqn on the Plan of Survey
attached hereto as Schedule "A" to this by-lal.' and sholqn as encroaching
upon First Street to the extent of 5 inches more or less are hereby
permitted to maintain and use such existing encroachment..
2. The permission hereby granted shall not confer upon the owners or occupants
any right, title or interest in the highway or the encroachment located
thereon other than the right to maintain and use such existing encroachment
so long as the said existing encroachment and the building of which it forms
part continue to exist, and such permission shall terminate upon the
encroachment or the building of which it forms part being demolished or
otherwise ceasing to existo
