By-Law Noo 75-31
A by-law to allow an encroachment onto the Road
Allowance of Emily Street, in the Geographic Village
of Newcastle, now in the Town of Newcastleo
WHEREAS the Estate of Hazel Margaret Miller is the owner of the lands and premises
being composed of Lot 5, Block 5, south of Emily Street, according to CoGo Hanning's
Plan, Village of Newcastle, now in the Town of Newcastle, Regional Municipalit~ of
Durham, more particularly described in Schedule "A" attached hereto;
AllD WHEREAS a survey of the said lands and premises, a copy of which is attached
hereto as Schedule "B" has disclosed that the dvlelling thereon has inadvertently
been erected on the south boundaries of the Emily Street Road Allowance;
NOW THEREFORE the Council of the Corporation of the Town of Newcastle pursuant to
The Municipal Act, R.SoOo 1970, Chapter 284, Section 354 (1) paragraph 93 HEREBY
ENACTS as follows:
1.
That the said Estate of Hazel Margaret Miller or the owner or occupant
from time to time of the residence property being Lot 5, Block 5, south
of Emily Street, according to CoGo Hanning's Plan, in the Town of
Newcastle, formerly in the Village of Newcastle, in the Regional
Municipality of Durham be allowed to maintain and use the encroachments
of their dwelling erected on the Road Allowance on the south side of
Emily Street as shown on the survey attached hereto as Schedule "B" .
until such time as the said dvlelling is demolished or for any reason
whatsoever ceases to be situated as shown on Schedule "B" attached
hereto.
20 That the said Estate of Hazel Margaret Miller or the owner or occupant
from time to time of the residence property being Lot 5, Block 5, south
of Emily Street, according to CoGo Hanning's Plan, in the Town of
Newcastle, formerly in the Village of Newcastle, in the Regional
Municipality of Durham has a right from time to time to make all necessary
repairs and renewals to the building but that this licence shall cease
to exist upon the happening of the following occurrances:
(A) The total destruction of the building shown in Schedule "B" as a
one-storey frame House (UuJ:1ber 95);
(B) Partial destruction so as to render the building, set out above,
uninhabitableo
3. That the owner of the said residence property, from time to time, pay to the
Town of Newcastle an annual fee of $1000 in advance for the right to maintain
and use the said encroachmento

ALL AND SINGULAR that certain parcel or tract of land and premises oituate
lying and being in the To,~ of Newcastle, in the Regional Municipality of
Durham, formerly in the Village of Newcastle, in the County of Durham, and
being composed of Lot 5 in Block 5 on the south side of Emily Street and
being part of TOvffiship Lot 28 in the First Concession of the Township of
Clarke, now within the limites of the Town of Newcastle, according to a
Plan made by CoGo Hanning, PoL.So dated January 11, 1868, which plan is
lodged in the Registry Office for the Registry Division of the West Riding of
the County of Durham. Containing one-fifth of an acre more or less.
