THE CORPORATION OF THE TOWN OF NEWc.A.S'rUi:
BY-LAW NO. 7$-29
Being a By-law to prohibit and regulate the discha:rge
of guns or other f!reams, air guns and spring guns
in the Town of Newcastle.
WJtIi!RF.AS Section 354 (1) (30) of the Munioipal. Act
1970, R. S. 0., Chapter 284, authorizes the Cotmcll of a Town to pass
by-laws tor prohibiting or regulating the disoba:rse of guns or other
f!reams, air guns and spriDg guns or en:y class or type thereof in the
municipal! ty in en:y defined area or &1:'eas thereof;

'.1!own of Newcastle deems it desirable to exercise the said power to the
extent here1naf'ter provided;
NOW ~ BE IT ERAO'J.'ED and it is h82!'eby
enacted as a by-law of the Corporation of the Town ot Newcastle by the
Council thereof as follows:
1. Except as otherwise provided by the express provisions of this by-law,
no person shall disoharse en:y gun, firea.1.'m, air sun or spring sun in
The Town of Newcastle.
2. Notwi thstanM ng the provisions of Section 1 of this by-law,
(a) The owners and oocupiers of land used for tam. purposes and
designated in the applicable zoning by-law as aerioul ture.1,
open space or undeveloped land, IIl8\V' disoba:rge a shotgun or
rifle of no greater calibre than .275 for the control of
pests upon land owned or occupied by the person so dis~fP.rJg
the shotgun or rifle, provided that no shot or bullet shall
pass over the boundary of the land so owned or occupied;
(b) A Hunter, having in his possession, all necessary licenses
required by the Province of Ontario, Dominion of Cenade. and
Town of Newcastle to permit him to hunt and to ca:rr:r and
discharge such gun, JDS\Y disoha'rge a shotgun or rifle ot no
~ater calibre than .275 upon the lands described in clause
(a) above, provided that he has the written consent of the
owner or oocupier of the said land, which consent bears a
date not more than one year prior to the date of the discharp
of the s~d shotgm'l or rifle, end which consent is available
on the person discharging the said shotgun or rifle, for
inspection by' any person requesting inspeotion of the same.

(0) A person mq disoharge a gun or other firearm in the ()()'U,S9
of a shooting competition or practice, provided that suoh
shooting competition or practice has been approved by a
resolution of the Corporation of the Town of Newcastle, and
provided further that such competition or practioe complies
wi th arr:r te1'mS or conditions upon which such approval has
been granted, and provided further that a copy of the
resolution of the Council of the Corporation of the Town of
Newcastle, granting such approval, is available for inspection
at the site of the competition or practioe by azq person
requesting inspection of the same.
(d) A person who is a member of an incorporated gun or shooting
olub mq discharge a gun or firea.rm in the course of olub
activities provided that suoh discha.rge takes place upon a
shooting range, the looation of which has: been approved by
resolution of the Council of the Corporation of the Town of
Newcastle and has been further approved by the Ministry of
the Solioi tor General for Ontario, and provided further that
a oopy of the said resolution and evidence of the said
approva.l is available at the shooting range for inspeotion
by arr:f person requesting inspection of the same.
(e) A person mq discharge a fireaxm or gun upon publio land
which has been designated as Crown Land by the P.rov1noe of
Ontario, or is subject to a wildlife extension a&reement.
3. The provisions of this by-law shall not apply to the discharge of
a gun or firearm by a:ny Peace Officer as defined in the Crimina.'L
Code of Canada. provided such discharge is in the course of the
performance of his duties as such Peace Offioer.
4. The provisions of this by-law shall not apply to prohibit the
disoharge of a gun or firearm by any Animal Control Offioer
employed by a municipality or gc~::':ernment, provided such discharge
takes place in the performance of his duties as such AnimA.l

5. Schedule "A" hereto annexed forma part of this by-law.
6. Every person who contravenes a:ny provision in this by-law shall
be gull ty of an offence and liable upon conviction to the penalty
of not less than $100.00 or more than $300000, exclusive of oosts.

7.
The tollowing by-laws or parts ot by-laws are hereby repealed:
By-law No. 666 ot the tomer Village ot Newoastle, passed
on October 14, 1952.
By-law No. 1736 ot the former Town of Bowmanville, passed
on September 14, 1959.
Any or all other by-laws or parts of by-laws ot the former Town
ot Bowmanville, Village of Newcastle, Township of Clarke and
Township of Darlington, inoonsistent with the provisions of
this By-law, be and the same are hereby repealed.
