BY-LAW NO. 79- 97 BEING A BY-LAW TO EXPROPRIATE CERTAIN LANDS REQUIRED FOR THE INSTALLATION OF A CULVERT FOR THE FOSTER CREEK UNDER THE ROAD ALLOWANCE BETWEEN CONCESSSION 2 AND 3 OF THE GEOGRAPHIC TOWNSHIP OF CLARKE, FORMERLY THE COUNTY OF DURHAM, NOW WITHIN THE LIMITS OF THE TOWN OF NEWCASTLE. BE IT ENACTED, and it is hereby enacted as a by-law of the Corporation of the Town of Newcastle by the Council thereof as follows:- . 1. THAT the lands described in Schedule "A" annexed hereto are hereby taken and expropriated for the purpose of i~stalling a culvert for the Foster Creek under the road allowance between Concessions 2 and 3, in the Geographic Township of Clarke, formerly the County of Durham, now within the limits of the Town of Newcastle. 2. THAT the Mayor and Clerk be, and the same are hereby authorized to sign a plan showing the lands expropriated by Section 1 of this by-law, and to affix the Corporate Seal of ~he Corporation thereto. 3. THAT the Clerk be authorized and directed to cause the Plan of Expropriation, when signed and sealed, to be registered in the proper Registry Office and to pay all expenses incidental to the registration, and to take such further action as may be required to obtain possession of the lands being expropriated in section 1 hereof. SCHEDULE "A" TO BY-LAW NO. 79- ~1 The following are the lands required for the installation of a culvert for Foster Creek under the Road Allowance between Concessions 2 and 3, in the Town of Newcastle, ln the Geographic Township of Clarke. PART 1. Part of Lot 30, Concession 2, Geographic Township of Clarke, former County of Durham, now within the limits of the Town of Newcastle in the Regional Municipality of Durham more particularly described as Part 3 according to a Reference Plan and registered in the Registry Office for the Registry Division of Durham (No. 10) as Reference Plan No. 10R-843.
