HomeMy WebLinkAbout79-82 e THE CORPORATION OF THE TOWN OF NEWCASTLE BY-LAW NUMBER 79- 82 being a By-law to amend Restricted Area By-law Number 79-44, as amended, of the former Village of Newcastle. WHEREAS the Council of the Corporation of the Town of Newcastle deems it advisable to amend Restricted Area By-law Number 79-44, as amended, of the former Village of Newcastle. NOW THEREFORE the Council of the Corporation of the Town of Newcastle ENACTS as follows: 1. Section 11 of By-law 79-44, as amended, is hereby further amended by adding thereto the following subsection 11.3: "11.3 SPECIAL CONDITIONS . (i) R3-l; Part of Lot 27, Concession 1 Notwithstanding any provisions of this By-law to the contrary, that portion of Lot 27, Concession 1 designated "R3-1" on the attached Schedule "A" hereto shall be used only in accordance with the following provisions and where there is any conflict between the regulations hereinafter set out and any other provisions of this By-law, as amended, the provisions of the "R3-1" zone shall apply but in the event that this special condition is silent on any matter, then the provisions of this By-law shall apply. . 1. Definitions. (a) Senior Citizen Apartment Building shall mean an apartment building operated by or for the Corporation or the Ontario - 2 - . Housing Corporation or any other non-profit organization and occupied primarily by elderly persons. 2. Permitted Uses a Senior Citizen Apartment Building and uses, buildings and structures accessory thereto. 3. Zone Provisions (i) Lot Area (minimum) 1.5 acres (ii) Lot Frontage (minimum) 60 feet (iii) Front Yard (minimum) 25 feet (iv) Interior Side Yard (minimum) 25 feet (v) Rear Yard (minimum) 25 feet . (vi) Dwelling Uni t Area (minimum) (a) dwelling unit containing one bedroom 600 sq. ft. (b) dwelling unit containing two bedrooms 700 sq. ft. (vii) Building Height (maximum) 40 feet (viii) Parking Spaces (minimum) .25 spaces per dwelling uni t 4. Site Plan Agreement Pursuant to Section 35(a) of the Planning Act, as amended, the lands zoned "R3-1", are hereby designated a site plan con- trol area. The Town of Newcastle shall require the owner of the lands to enter into one or more agreements in respect of the development of the subject lands prior to any development being undertaken." . - 3 - . 2. Schedule "AIf to By-law Number 79-44, is hereby amended by changing to "R3-l" the zone designation of the lands designed "ZONE CHANGE TO R3-1" on the attached Schedule "X" hereto. 3. This By-law shall become effective on the date hereof, subject to receiving the approval of the Ontario Municipal Board. THIS BY-LAW READ a first time this 21'day of ~/, A.D. 1979.
