THE CORPORATION OF THE
TOWN OF NEWCASTLE
By-law Number 79- 81
A By-law to amend By-law 77-84 of the Town
of Newcastle, being a By-law to amend Restricted
Area By-law Number 2111, as amended, of the former
Township of Darlington.
WHEREAS the Council of the Corporation of the Town of Newcastle has
approved By-law 77-84.
AND WHEREAS the Ontario Municipal Board, cognizant of the interests
of the objectors to the By-law, has expressed an unwillingness to
approve By-law 77-84, as submitted, and has suggested that the Council
of the Town of Newcastle amend said By-law to apply the provisions of
Section 35(a) of the Planning Act to the subject lands.
AND WHEREAS the Council of the Corporation of the Town of Newcastle
subsequently approved By-law 79-10 to apply the provisions of Section
35(a) of the Planning Act to the subject lands.
AND WHEREAS By-law 79-10 did not properly enact the provisions of
Section 35(a) of the Planning Act.
NOW THEREFORE the Council of the Corporation of the Town of Newcastle
ENACTS as follows:
1. By-law 79-10 of the Corporation of the Town of Newcastle is

hereby repealed.
2. Section 1 of By-law 77-84 is hereby amended by adding thereto, after
the words "without the written consent of the Central Lake Ontario
Conservation Authority", the following:
"Pursuant to Section 35(a) of the Planning Act, as amended, the
lands zoned "TC-l" on the attached Schedule "X" are hereby designated

a Site Plan Control Area. The Town of Newcastle shall require
the owner of the lands to enter into one or more agreements in
respect of the development of the subject lands prior to any
development being undertaken."
3. This By-law shall come into effect on the date hereof, subject
to receiving the approval of the Ontario Municipal Board.
