A By-law to amend Restricted Area By-law
Number 2111, as amended, of the former
Township of Darlington
WHEREAS the Council of the Corporation of the Town of Newcastle DEEMS
it advi sab 1 e to amend Res tricted Area By-l aw Number 2111, as amended,
of the former Township of Darlington.
NOW THEREFORE the Council of the Corporation of the Town of Newcastle
ENACTS as follows:

1. Section 2 of By-law 2111, as amended, is hereby further
amended by adding thereto the following subsection (v) (2):
II(V) (2) RESTAURANT means a building or part of a building where
food is offered for sale or sold to the public for immediate
consumption in the dining room of such building. II
2. Section 2 of By-law 2111, as amended, is hereby further
amended by adding thereto the following subsection (v) (3):
II (v) (3) RESTAURANT, TAKE OUT means a bui 1 di ng or part of a buil di ng
where food is offered for sale or sold to the public for
consumption off the premises.1I
3. Section 2 of By-law 2111, as amended, is hereby further
amended by adding thereto the following subsection (z) (b) (1):

"(z) (b) (1) STORE, CONVENIENCE RETAIL means a retail store, with a
gross floor area of 1500 square feet or less, where groc-
eries, meats, beverages, dairy products, patent medicines,
sundries, tobacco, stationery, hardware, magazines, news-
papers or similar items of household necessity are kept
for sale to residents of the immediate neighbourhood."

4. Section 7 Cd) of By-Law 2111, as amended, is hereby further
amended by adding thereto the following subsection (5), as follows:
"(5) C2-4; Lot 22, Concession 2
Notwithstanding any provision of this By-law to the con-
trary, the parcel of land located in Lot 22, Concession 2,
and designated "C2-4" on the attached Schedule "X" hereto
may be used only for the purpose of a convenience retail
store and/or a take-out restaurant with ancillary eating area,
provided that no building permit shall be issued in respect
of the subject lands until the owner of the said lands has entered
into a Development Agreement, as described in Section 35Ca)
of the Planning Act, with the Corporation of the Town of
Newcastle."
5. Map 22 of Schedule "A" to By-law 2111, as amended, is hereby
further amended by changing to "C2-4" the zone designation of the lands
shown as "ZONE CHANGE to C2-4" on the attached Schedule "X" hereto.
6. This By-law shall come into effect on the date hereof, subject
to receiving the approval of the Ontario Municipal Board.
