HomeMy WebLinkAbout79-50 . ~ t .....~ . . .; I . t . e e ,...-..JI '1\ CORPORATION OF THE TOWN OF NEWCASTLE By-law No. 79- 50 A By-law for prohibiting the obstructing of any drainage or water-course within the Town of Newcastle WHEREAS, the Council of the Corporation of the Town of Newcastle deems it necessary to prohibit the obstruction of any drain or water-course within the limits of the Town of Newcastle, and; WHEREAS, the Council of the Corporation of the Town of Newcastle deems it necessary to require the person causing the obstruction to remove it, and; WHEREAS, the Council of the Corporation of the Town of Newcastle, pursuant to The Municipal Act, R.S.O. 1970, Chapter 284, Section 352, Subsection 19, has authority to enact this By-law; NOW THEREFORE, the Council of the Corporation of the Town of Newcastle enacts as follows: 1. No persons or persons shall obstruct or cause to be obstructed any drain or water-course within the boundaries of the Corporation of the Town of Newcastle. 2. In the event any person or persons who fail to remove an obstruction from any drain or water-course the Corporation of the Town of Newcastle, its servants or agents, may remove the obstruction and the expenses so incurred in such cases, maybe recovered by action, or the amount may be entered in the tax collectors roll and recovered in the like manner as municipal taxes. 3. Any person or persons who contravenes any provision in this By-law shall be guilty of an offence and liable, upon conviction, to a penalty of not less than $100.00 and not more than $1,000.00 exclusive of costs, for each offence and every penalty shall be recoverable under the provisions of The Summary Convictions Act. ,~,. I~' .. * '. e e e , . By-law 1179- 50 (2) 4. By-law No. 1639 of the former Township of Clarke, By-law #75-67 of the Corporation of the Town of Newcastle and By-laws or parts of By-laws of the former Village of Newcastle, the former Township of Darlington and the former Town of Bowmanville, inconsistent with the provisions of this By-law are hereby repealed. This By-law shall come into force and take effect on the day of enactment. By-law read a first and second time this .~th. day of ..June....... 1979.
