By-Law No. 79-34
.
Being a by-law to designate the Bowmanville
Museum of Architectural and Historic Value.
WHEREAS the Ontario Heritage Act, 1974, authorizes the Council
of a municipality to enact by-laws to designate real property, including
all the buildings and structures thereon to be of historic or archi-
tectural value or interest; and
WHEREAS the Council of the Town of Newcastle has caused to be

served upon the owner of the lands and premises known as the Bowmanville
Museum, situated at 37 Silver Street, former Town of Bowmanville, now
in the Town of Newcastle, in the Region of Durham, and upon the Ontario
Heritage Foundation, notice of intention to so designate the aforesaid
real property and has caused such notice of intention to be published
in a newspaper having a general circulation in the municipality once
for each of three consecutive weeks; and
WHEREAS the Bowmanville Museum, 37 Silver Street, Bowmanville, is
recommended for designation for historical reasons because it was the
home of David Fisher, a local merchant who served on Bowmanville's first
municipal council and who later became the local Collector of Customs,
and eventually cashier of the Ontario Bank. It was also the home of
J.H.H. Jury, one of the founders of the chain of Jury and Lovell drug-
stores and an equally prominent local citizen. It is also recommended
for designation for architectural reasons as it is one of the earliest
brick houses built in Bowmanville (c. 1847) and because in 1861, the

pretentious home in the italianate style and as such represents the
best example of that style known to have been built in Bowmanville.
AND WHEREAS the Local Architectural Conservation Advisory Committee
of the Town of Newcastle has recommended that the buildings and property
be 'designated property' under the terms of the Ontario Heritage Act:
WHEREAS no notice of objection to the proposed designation has
been served upon the Clerk of the municipality;
NOW THEREFORE, the Council of the Corporation of the Town of
Newcastle ENACTS AS FOLLOWS:
1 .
There is designated as being of historic and architectural value
of interest the real property more particularly described in
Schedule ItAu hereto, known as the Bowmanville Huseum, 37 Silver
Street, in the former Town of Bowmanville, now Town of Newcastle.
2. The Town Solicitor is hereby authorized to cause a copy of this
by-law to be registered against the property described in Schedule
uA" hereto in the proper land registry office.
3. The Town Clerk is hereby authorized to cause a copy of this bY-law
to be served upon the owner of the aforesaid property and upon the
Ontario Heritage Foundation and to cause notice of this by-law to
be published in a newspaper having general circulation in the Town
of Newcastle.

SCHEDULE A TO BY -LAW NO. 79-34
ALL AND SINGULAR that certain parcel or tract of/ land and premises
situate, lying and being in the Town of Newc~stle, Regional Municipali y
of Durham, Province of Ontario, and being composed of all of Town
Lot 170 and parts of Town Lots 169, 171 and 172, fronting on Wellingto
Street, Block L, according to John Grant's Plan of the former Town of
Bowmanville, more particularly described as follows;
, COMMENCING at a point in the Northerly limit of said Town Lot 169
88 feet measured Westerly in the Southerly limit of Wellington Street
from the North-Easterly angle of said Block L;
THENCE Southerly in a straight line a distance of 61.50 feet to a
point distant 89.50 feet measured Westerly on a course parallel to
the Northerly limit of said Block L from a point in the Easterly _
limit of said Block L which is 61.50 feet measured Southerly therein
from the North-Easterly angle thereof;
THENCE Westerly parallel to the Northerly limit of said Block L a
distance of 50 feet;
THENCE Southerly parallel to the Easterly limit of said Block L a
distance of 103.5 feet more or less to a point in the Southerly limit
of said Town Lot 169;
THENCE Westerly along the Southerly limits of said Town Lots 169,170
and 171 a distance of 102.8 feet more or less to a point which is
130 feet measured Easterly in the Southerly limits of said Town Lots
171 and 172 from the South-Westerly angle of said Town Lot 172;
THENCE Northerly parallel to the Westerly limit of said Blobk L a
distance of 1.25 feet;
THENCE Westerly parallel to the Southerly limits of said Town Lots
171 and 172 a distance of 130 feet to a point in the Westerly limit
of said Town Lot 172;
THENCE Northerly along said last-mentioned limit, being the Easterly
limit of Silver Street, a distance of 164 feet more or less to the
North-Westerly angle of said Block L;
THENCE Easterly along the Northerly limits of said Town Lots 172, 171,
170 and 169, being the Southerly limit of Wellington Street, a distanc
of 292.70 feet more or less to the POINT OF COMMENCEMENT.
