THE CORPORATION OF THE TOWN OF NEWCASTLE
BY-LAW NO. 79-118
being a by-law to stop up and close part of
original road allowance across Lot 26, between
Concessions 5 and 6, Geographic Township of Clarke,
former County of Durham designated as parts I and 2
on Plan IOR935
WHEREAS the Council of the Corporation of the Town of Newcastle
deems it desirable to pass this by-law;
AND WHEREAS notice of intention of Council to pass the said by-law
in accordance with the requirements of Section 446 of the
Municipal Act, R.S.O. 1970, Chapter 284, was published in the
Orono Times on the following dates:
October 3 1979, October 10, 1979, October 17 1979, October 24 1979,
AND WEREAS notice of the intention of the Council to pass this by-law
was sent by registered mail to the Regional Municipality of Durham,
on the 7th day of June 1979, and the Regional Council has granted
approval to the proposed by-law.
NOW THEREFOR BE IT ENACTED AND IT IS HEREBY ENACTED AS A BY-LAW OF
THE CORPORATION OF THE TOWN OF NEWCASTLE AS FOLLOWS:
1. That portion of the road allowance in the Town of Newcastle
hereinafter described is hereby stopped up and closed:
ALL AND SINGULAR that certain parcel or tract of
land and premises situate, lying and being in the
Town of Newcastle, Regional Municipality of Durham,
Province of Ontario, and being composed of Parts
I and 2, forming part of original road allowance
across Lot 26 between Concessions 5 and 6 of the
former Township of Clarke, which parts are shown on a
Plan of Survey prepared by Merrill D. Brown Limited,
O.L.S. and registered as No. IOR935.
2. That portion of the road allowance hereinbefore described
shall be conveyed by the Corporation of the Town of Newcastle to
abutting owners.
