By-law No. 81- 99
being a By-law to amend Restricted Area By-law
No. 1587, as amended, of the former Town of
Bowmanville.
WHEREAS the Council of the Corporation of the Town of Newcastle DEEMS
it advisable to amend Restrict Area By-law No. 1587, as amended, of
the former Town of Bowmanville.

NOW THEREFORE the Council of the Corporation of the Town of Newcastle
ENACTS as follows:
1.
Map 6 of Schedule "A" to By-law 1587, as amended, is
hereby further amended by changing to Special Condition

19 the zone designation of the lands indicated as "ZONE
CHANGE TO SPECIAL CONDITION 19" on the attached Schedule
"A" hereto, and by adding to the lands so indicated cross-
hatching and the figure 19 encircled.

Schedule "B" to By-law 1587, as amended, is hereby further
amended by adding thereto the following:
"SPECIAL CONDITION 19
That parcel of land in part of Lot 9, Broken Front Concession
as shown on Schedule "A" to this By-law 81-99 cross-hatched
and marked with the figure 19 encircled shall be subject to
the provisions hereinafter contained and where there is any
conflict between the provisions hereinafter set out and any
other provisions of By-law 1587, as amended, then the provisions

of this Special Condition will apply, but in all other respects
the provisions of By-law 1587, as amended, shall apply.

1.1 Defined Area
The area subject to this special condition is shown
cross-hatched with the figure 19 encircled on the
attached Schedule "A" to this By-law 81- 99
1.2 Definitions
For the purposes of this special condition

BOAT REPAIR SHOP shall mean a building or structure
wherein pleasure boats, yachts and appurtenant equip-
ment are repaired, maintained or constructed.
BOAT STORAGE AREA shall mean an enclosed area which
may contain buildings or structures and which is used
for the outside storage maintenance and/or repair of
pleasure boats, yachts and appurtenant equipment.
Permitted Uses

No person shall use any of the lands or erect, alter or
use any building or structure on such land for any purpose
except in accordance with the following provisions:
a boat repair shop
a boat storage area
1.4 Zone Provisions
(a) Lot Area (minimum) 1 hectare
(b) Lot Frontage (minimum) 75 metres
(c) Front Yard (minimum) 30 metres
(d) Side Yard (minimum) 14 metres
(e) Rear Yard (minimum) 8 metres

(f) Building Height (maximum)
10.5 metres
(g) Lot Coverage (maximum)
Boat repair shop
Boat storage area

(h) Landscaped Area (minimum)

(i) Parking Spaces (minima)

metres of gross floor area
(j) No open storage shall be permitted within 1.2 metres
of any property boundary.

This By-law shall come into effect on the date hereof
subject to the provisions of Section 35(10) of the Planning
Act.
