By-law Number 81- 71 a By-law to amend Restricted Area By-law Number 1592, as amended, of the former Township of Clarke. WHEREAS the Council of the Corporation of the Town of Newcastle deems it advisable to amend Restricted Area By-law 1592, as amended, of the former Township of Clarke. NOW THEREFORE the Council of the Corporation of the Town of Newcastle ENACTS as follows: 1. Section 10.3 of By-law 1592, as amended, is hereby further amended by adding thereto the following subsection (L): "(L) A-13 Part Lot 25, Concession 7 . Notwithstanding any provisions of this By-law to the contrary, that part of Lot 25, Concession 7, designated "A-13" on Schedule "A" hereto shall be used only in accordance with the following provisions: (1) Permitted Uses (a) a commercial retail store, meaning a building or part thereof in which goods, wares, mer- chandise, substances, articles or things are offered or kept for sale by retail directly to the public. (b) a restaurant, means a building or part thereof in which food is prepared or sold for consumption either on the premises or elsewhere, and shall . include a drive-in or take-out restaurant, and a dining lounge or club where full course meals I File No............frl.9..:..S.5..J'l'L.../ are served, but shall not include a tavern, place of assembly or food service establishment. . . - 2 - . (c) a business office. (d) one single family dwelling and buildings and structures accessory thereto. (2) Zone Provisions (a) Lot Area (minimum) (b) Lot Frontage (minimum) (c) Front Yard (minimum) (d) Interior Side Yard (minimum) (e) Rear Yard (minimum) (f) Parking Spaces (minimum) 2 3870.0 m 100 metres 10.6 metres 12.5 metres 6.0 metres 2 parking spaces per dwelling unit, and . 1 parking space per 23 m2 of retail com- mercial floor space, and/or 1 parking space per 11 m2 of restaurant floor space. (g) Building Height (maximum) 10.6 metres (h) Building Coverage (maximum) 30% (i) Landscaped Area (minimum) 25% 2. This By-law shall become effective on the date hereof, subject to receiving the approval of the Ontario Municipal Board. . .. . . .
