THE CORPORATION OF THE TCWN OF NEWCASTLE
By-law No. 81-22
Being a by-law to authorize the 'Ibvm of Newcastle Game Corrmission
to issue and charge fees for licenses to hunt during the open
season, pheasants and rabbits
WHEREAS, Section 39 of The Game and Fish Act, R.S.O. 1970, Chapter 186, as amended,
provides that the Minister of Natural Resources may, in writing, authorize any
Municipality to pass by-laws for issuing and fixing the maximum number of licenses
to hunt during the open season, pheasants and rabbits and for charging such fees
therefore as he authorizes; the Minister may also fix the minimum number of such
licenses that the by-law shall provide for:
NCW' THEREFORE, The Municipal Council of the CorfX)ration of the 'Ibwn of Newcastle,
enacts as follows:
1)
That no persons shall hunt pheasants or rabbits within the 'Ibvm of Newcastle
within the Reigon of Durham, until a license for that purpose has been
obtained, and such licenses to be in addition to any other licenses required
by The Game and Fish Act, R.S.O. 1970, Chapter 186, as amended.
2)
The 'Ibwn of Newcastle GaIre Commission appointed from time to time by the
Council, shall issue and sell the following:
.
(a) a license for non-residents of the 'Ibvm of Newcastle, to hunt
pheasants and rabbits at a fee of ($7.50) seven dollars and fifty
cents, plus (.509) fifty cents issuing fee;
(b) a license for residents of the 'Ibwn of Newcastle to hunt pheasants
and rabbits at a fee of ($3.50) three dollars and fifty cents, plus
(.509) fifty cents issuing fee.
3) The fee prescribed shall be paid for each license when same is issued.
4) The license issuer shall receive (.509) fifty cents for each non-resident
license and (.509) fifty cents for each resident license issued.
5) In this by-law, the WJrds"RESIDENT OF THE TCWN" means any person who is
a resident of the 'Ibvm of Newcastle.
6) In this by-law, the words "NON-RESIDENT OF THE 'I'CMN" means any person
who does not reside within the 'Ibwn of Newcastle.
7) A minimum of 200 licenses must be made available for the use of non-residents
and no restrictions on the number available to residents of the 'Ibwn of
Newcastle.

8) That By-law #2007 and all previous by-laws passed by the 'Ibwn of Newcastle
for which are inconsistent herewith be, and the same are hereby repealed.

IT IS ALSO PROVIDED, that this by-law does not apply to any land of the Crown,
and any land cormonl y known as wildlife extension land owners agreement area
situated within the areas referred to in this by-law.
This by-law shall come into force and effect on the date of the final passing
thereof, subject to the Minister of Natural Resources authorizing in writing,
the passing of the by-law.

Dear Mr. McIlroy:
This will acknowledge receipt of a copy of
By-law No. 81-22 relative to the issuing of licences for
hunting of pheasants and rabbits.
Pursuant to section 39 of The Game and Fish
Act, R.S.O. 1970, c. 186, I hereby authorize the Corporation
of the Town of Newcastle to pass By-law No. 81-22, for
issuing of licences to hunt, during the open season,
pheasants and rabbits and charging such fees therefor that
the by-law indicates.
