THE CORPORATION OF THE
TOWN OF NEWCASTLE

By-Law Number 81-15 3
Being a by-law to amend Restricted Area By-law
Number 2111, as amended, of the former Township
of Darlington now in the Town of Newcastle.
WHEREAS the Council of the Corporation of the Town of Newcastle deems
it advisable to amend Restricted Area By-law Number 2111, as amended, of
the former Township of Darlington;
NOW THEREFORE the Council of the Town of Newcastle ENACTS as follows:-
1) Schedule "A" to By-law 2111, as amended, is hereby further amended
by adding the designation "Special Provision By-Law 81-15 3" to the
zoning designation of the lands indicated as "Zone Change to Provision

By-law 81- 153' on the attached Schedules 'XlI and 'X2 ' hereto.
2)
By-law 2111, as amended, is hereby further amended by adding to
Section 13 the following subsection (hh):-
"(hh) Notwithstanding any provision of this by-law to the
contrary, those lands outlined and designated "SPECIAL
PROVISION BY-LAW 81- 153' on Schedule 'A' hereto shall
only be used in accordance with the following provisions.
In the event that there is any conflict between the
provisions of this SPECIAL PROVISION and any other provisions
of this By-law 2111, as amended, then the provisions of this
SPECIAL PROVISION shall apply, but in the event that this
SPECIAL PROVISION is silent on any matter, then the provisions
of this By-law 2111, as amended, shall apply.

2.1) Defined Area
The areas subject to this Special Provision are outlined and designated
Special Provision By-Law 81- 15yn Schedule "A" to this By-law.
2.2) Definitions
2.2.1 Group Home shall mean a single housekeeping unit in a single
family dwelling in which three to ten residents, excluding
staff and/or receiving family, live as a family under responsible
supervision, consistent with the requirements of the residents.

Group Homes shall be licenced and/or approved under Provincial
statutes and shall not be permitted to locate within 300 metres
of another group home. Furthermore, only one group home
hOlSing elementary or junior high school aged children may be
located wi thin the area served by any public elementary or
junior high school.
2.3) Permitted Uses
In addition to those uses permitted by By-law 2111, a group home
shall also be a permitted use on those lands subject to Special
Provision By-Law 8lJ53 and shall be used in accordance with the
applicable zone provisions.
3) This By~Law shall come into effect on the date hereof subject to the
provisions of Section 35(10) of the Planning Act.
