BY -LAW NO. 81- 143 Being a by-law to further amend By-Law No. 78-53, being a by-law to govern the proceedings of the Council of the Corporation of the Town of Newcastle, any of its Committees, the conduct of its Members and the calling of meetings. . WHEREAS Section 242 of The Municipal Act authorizes Municipal Councils to pass by-laws for governing the proceedings of Council, conduct of its Members, and the calling of meetings; AND WHEREAS Council desires to further amend By-Law 78-53, being a by-law passed pursuant to Section 242 of The Municipal act. NOW THEREFORE THE COUNCIL OF THE TOWN OF NEWCASTLE ENACTS AS FOLLOWS: . 1. Section 1 of By-Law 78-53 is amended by adding the following subsection: (j) "Standing Committee" means the "General Purpose and Administration Committee of Council" and for the purposes of this by-law means a standing committee or "Standing Committees". . 2. Section 8 of By-Law 78-53 is deleted in its entirety and replaced with the following: 8 (a) There shall be one (1) Standing Committee of Council, namely the "General Purpose and Administration Committee". 8 (b) The "General Purpose and Administration Committee shall be composed of all Members of Council. 8 (c) The Chairman of the "General Purpose . and Administration Committee" shall be appointed by Council. 8 (d) o 1 all No. _______ __'__" ..-..----- -- -- -- -- -- - - -- -- ---- .----- -- The Mayor shall be the ex-officio member Standing Committees with the same rights \ File .......2 " ' " - <' V< , . . . . . . . ./ -Page 2- and privileges of all other members of the Committee. 8 (e) Council shall appoint the time and place of meetings of the "General Purpose and Administration Committe". 8 (f) Appointments to other Committees and Boards shall be recommended to Council be a Striking Committee composed of the Mayor, one Regional Councillor and one Local Councillor. 3. Sections (10.1), (10.2), (10.3) and (10.4) are deleted in their entirety and replaced with the following: 10. The Terms of Reference of the General Purpose and Administration Committee shall be as per Schedule "A" attached hereto. BY-LAW READ a first time this 21st day of September, 1981. Schedule "A" to By-Law No. 81-143 SCHEDULE "A" TERMS OF REFERENCE OF THE GENERAL PURPOSE AND ADMINISTATION COMMITTEE A. To consider and report to Council on all matters brought before it by the Chief Administrative Officer in respect of the administration and operations of the Town. B. In accordance with (a) above, to consider all reports from the departments of the civic administration, as approved by the Chief Administrative Officer, in respect of the following: 1. The preparation of the annual budget and all proposed capital expenditures which may involve the issue of debentures, budget forecasting, economic appraisals of proposed developments, financial impacts of various programs and the management of investments. 2. To prepare es tima tes 0 f the, proposed revenue and expenditures for the year and Monthly Progress Statements to be presented to Council for its consideration. 3. To consider and recommend to Council, all accounts for payment. 4. To consider and recommend to Council all Collective Agreements and other personnel matters. 5. To consider and recommend to Council all matters in connection with the erection and maintenance of Corporation Buildings. 6. To consider and report to Council on all by-laws and legal matters that have been referred by Council. 7. To consider and recommend to Council the establishment and maintenance of Public Parks and playgrounds. 9. To consider and recommend to Council the establishment of Cultural and Recreational Programs 10. To consider and recommend to Council on the establishment, maintenance and control of active and abandoned cemeteries under the jurisdiction of Council, including the administation and application of the Cemetery By-Laws of the Corporation. 11. To consider the report to Council on all matters connection with Fire Protection as provided by the Fire Department of the Corporation. 12. To consider and report to Council on the administation and application of Fire By-Laws of the Corporation including the enforcement thereof. 13. To consider and recommend to Council on all matters of planning relating to processing, circulation and comments on zon~ng by-laws, amendments to Official Plans, processing, circulation and comments on residential, industrial and commercial plans of subdivision applications; district plans for urban areas, secondary plans, hamlet district plans, plans for rural areas, long term and development growth strategy, special studies for central areas; housing policies; the Town's position in regard to land severance applications, and the Town's position in regard to Committee of Adjustment applications. 14. To consider and recommend to Council a program to attract industry to the municipality and act as the Council's Industrial Committee. 15. To consider and recommend to Council the engagement of Consultants with respect to the Planning and Development of the Town. 16. " , . . . . . -Page 3- Schedule "A" to By-Law 81- 143 maintenance of roads, ditches, culverts and bridges, storm drainage, sidewalks and other utilities where the Town is involved (gas, hydro telephone, etc.) within the jurisdiction of the Corporation. 17. To consider and recommend to Council the engagement of consultants regarding studies pertaining to roads, streets and traffic, storm drainage, etc., and to consider and recommend to Council all by-laws relating to The Highway Traffic Act. 18. To consider and recommend to Council on all matters r&ecting proposed developments, boundary agreements, lot grading plans, street naming and on all proposed road and street openings and closing and by-laws relating thereto. 19. To consider and recommend to Council on all matters respecting the operation of Town services (garbage pick-up and traffic operations). 20. To consider and recommend to Council on all matters respecting the provision of municipal off-street and on-street parking. C. In accordance with A and B (above) to consider and report to Council on any other matter or matters affecting the operations or administration of the Town, including the procedures of the Committee and Council and the organization of civic administration.
