WHEREAS the Council of the Corporation of the Town of Newcastle DEEMS it advisable to amend Restricted Area By-law Number 1592, as amended, of the former Township of Clarke. NOW THEREFORE the Council of the Corporation of the Town of Newcastle ENACTS as follows: 1. Section 5.3 of By-law 1592, as amended, is hereby further amended by adding thereto the following subsection (d): "(d) Leskard Road RR-4 Notwithstanding any provisions of this By-law to the contrary, that parcel of land designated "RR-4" on the attached Schedule "A" hereto shall be used only in accordance with the following provisions. Notwith~~andi~ra;~~t l(a) hereto, no person shall use, erect, place or alter any building or structure or private sanitary waste disposal system or place or remove fill of any kind within that area defined as Hazard Lands being all lands below the topographic top of bank, of the Wilmot Creek Valley, as defined by the Conservation Authority having jurisdiction. Lands identified as being'lIazard Lands" may be used for erosion and flood control purposes subject to the regu- lations of the Conservation Authority having t -File NO'n__,~O-,__~_~_.-j~05____1 - 2 - . jurisdiction. Furthermore, prior to the issuance of building permits in respect of building or structures to be erected within 7.5 metres of the area defined as Hazard Lands, the written approval of building siting plans shall be required from the Conservation Authority having jurisdiction. Schedule 'A' to By-law Number 1592, as amended, is hereby further amended by changing to "RR-4" the zone designation Schedule "X" hereto. of the lands designated "ZONE CHANGE TO RR-4" on the attached 3. Oakes hereby certify that the notice for By-Law Number 81-135 of The Corporation of the Town of Newcastle, passed by Council of the Corporation on the 21st day of September 1981 was given in the manner and form and to the persons prescribed by regulations made by the Lieutenant Governor-in-Council under subsection 24 of section 35 of The Planning Act. I also certify that the 21 day objection period expired on November 4, 1981 and to this date no notice of objection or request for a change in the provisions of the by-law has been filed by any person in the office of the Clerk. By-Law Number 81-135 is hereby approved. Dated this 6th day of November 1981
