THE CORPORATION OF THE

By-law Number 8l- 133
being a By-law to amend Restricted Area By-law
Number l592, as amended, of the former Township
of Clarke.
WHEREAS the Council of the Corporation of the Town of Newcastle
DEEMS it advisable to amend Restricted Area By-law l592, as amended,
of the former Township of Clarke.
NOW THEREFORE the Council of the Corporation of the Town of Newcastle
ENACTS as follows.

1.
Appendix 1 of By-law l592, as amended, is hereby further
amended by deleting Section 1 (j) in its entirety and re-
placing said section with the following new subsection
1 (j):
"l (j)
Farmer Retaining Lot
Notwithstanding any provisions of this By-law to the contrary,
a bona fide farmer, whose chief source of income is derived
from farming operations, consisting in whole or in part of
growing crops, raising cattle or livestock, or operating a
dairy farm, in an agricultural zone may, with the permission
of the Land Division Committee and in accordance with the
provisions of this By-law for 'RR' zones, retain a retirement
lot from the sale of his farm and erect or use thereon a single

family dwelling or may create a lot for one member only of the
farmer's immediate family provided such person is employed or
significantly assists in the operation of the farm."
2.
This By-law shall come into effect on the date hereof, subject
to the provisions of Section 35 (10) of the Planning Act.
