THE CORPORATION OF THE TOWN OF NEWCASTLE BY - LAW 81 - 11 2 Being a by-law to amend By-Law No. 77-82 entitled "A by-law to designate the Old Kirby School of Architectural and Historic Value". WHEREAS Section 31 subsection (1) of The Ontario Heritage Act, 1974 provides that the Council of a Municipality may repeal a by-law, or part thereof designating a property as being of architectural or historic value; and WHEREAS the Council of the Corporation of the Town of Newcastle deems it advisable to amend By-Law No. 77-82. NOW THEREFORE the Council of the Corporation of the Town of Newcastle ENACTS AS FOLLOWS: . 1. That the following recitals in by-law No. 77-82 be, and the same are hereby repealed: 1. There is designated as being of historic and architectural value of interest the real property more particularly described in Schedule "A" hereto, known as the Old Kirby School at the junction of Highway 115 and Concession 7, former Township of Clarke, now Town of Newcastle. 2. The Town Solicitor is hereby authorized to cause a copy of this by-law to be registered against the property described in Schedule "A" hereto in the property land registry office. 3. The Town Clerk is hereby authorized to cause a copy of this by-law to be served upon the owner of the aforesaid property and upon the Ontario Heritage Foundation and to cause notice of this by-law to be published in a newspaper having general circulation in the Town of Newcastle. 2. That the following recitals are substituted therefore: 1. That the real property more particularly described as Part 2 of Reference Plan lOR-l289 and attached as Schedule "A" to By- Law No. 81-112 be substituted therefore; and 2. The Town Solicitor is authorized to cause a copy of By-Law No. 81-112 to be registered against the property described in Schedule "A" to By-Law No. 81- 112in the appropriate Land Registry Office; and 3. The Town Clerk is authorized to cause a copy of By-Law No. 81-112 to be served upon the owner of the aforesaid property and upon the Ontario Heritage Foundation and to cause notice of By-Law No. to be published in a newspaper having a general circulation in the Town of Newcastle.
