By-law No. 81-101
being a by-law to amend Restricted Area By-law 79-44,
as amended.
WHEREAS the Council of the Corporation of the Town of Newcastle
DEEMS it advisable to amend Restricted Area By-law 79-44, as amended.
NOW THEREFORE the Council of the Corporation of the Town of Newcastle
.
ENACTS as follows:
1. Section 12 of By-law 79-44, as amended, is hereby further
amended by adding thereto the following subsection 12.5:
"12.5
SPECIAL PROVISION FOR CF-3 ZONE
.
Notwithstanding any provision of this by-law to the
contrary, the lands designated CF-3 on the attached
Schedule "A" hereto shall only be used in accordance
with the following provisions:
.
1) Permitted Uses
a church
a church hall
a rectory
an elementary school
private or public park
2) Zone Provisions
(a) Lot Area (minimum)
2.0 hectares
(b) Lot Frontage (minimum)
75.0 metres
(c) Front Yard (minimum)
20.0 metres
.
(d) Side Yard (minimum)
10.0 metres

(e) Rear Yard (minimum)
20.0 metres
(f) Building Height (maximum)
12.5 metres
(g) Parking Spaces (minimum)
In accordance with Section
3.15 hereof.
2. Schedule "A" to By-law 79-44, as amended, is hereby further
amended by changing to "CF-3" the zone designation of the lands
designated "ZONE CHANGE TO CF-3" on the attached Schedule "X"
hereto.

This By-law shall come into effect on the date hereof, subject
to the provisions of Section 35 (10) of the Planning Act.
