THE CORPORATION OF THE TOWN OF NEWCASTLE BY-LAW NO. 83-41 being a by-law to stop-up and close and to authorize the sale of all that portion of the original road allowance between Lots 4 and 5, Concession 4, in the former Township of Clarke WHEREAS the Council of The Corporation of the Town of Newcastle deems it desirable to pass this by-law; AND WHEREAS notice of intention of the Council to pass the said by-law in accordance with the requirements of Section 301, Chapter 302, of The Municipal Act, R.S.O. 1980, was published in the Orono Weekly Times on February 16, February 23, March 2, March 9, 1983. AND WHEREAS notice of the intention of the Council to pass this by-law was sent by registered mail to the Regional Municipality of Durham on the 10th day of February 1983, and the Regional Municipality of Durham granted approval of the proposed by-law by letter dated the 2nd day of March , 1983; NOW THEREFOR BE IT ENACTED AND IT IS HEREBY ENACTED AS A BY-LAW OF THE CORPORATION OF THE TOWN OF NEWCASTLE AS FOLLOWS: 1. All that portion of the original road allowance between Lots 4 and 5, Concession 4, in the former Township of Clarke, hereinafter described is hereby stopped up and closed: ALL AND SINGULAR that certain parcel or tract of land, situate, lying and being in the Town of Newcastle, Regional Municipality of Durham, Province of Ontario, and being composed of all that portion of the original Road Allowance between Lots Four (4) and Five (5) in the Fourth Concession of the Geographic Township of Clarke, formerly in the County of Durham, more particularly designated as Parts One (1), Two (2), Three (3) and Four (4) according to a Plan of Survey deposited in the Land Registry Office for the Registry Division of Newcastle (No. 10) on the 12th day of January 1983, as Plan 10R-1577. All that portion of the said road allowance hereinbefore described shall be conveyed by The Corporation of the Town of Newcastle to abutting owners.
