THE CORPORATION OF THE TOWN OF NEWCASTLE BY-LAW NUMBER 83- 27 being a By-law to amend By-law Number 2111, as amended, of the former Township of Darlington, now in the Town of Newcastle. WHEREAS the Council of the Corporation of the Town of Newcastle deems it advisable to amend Restricted Area By-law Number 2111, as amended, of the former Township of Darlington. NOW, THEREFORE, the Council of the Corporation of the Town of Newcastle enacts as follows: 1. Section 13 of By-law 2111, as amended, is hereby further amended by adding thereto the following subsection (aa): "(aa) Part of Lots 32 and 33, Concession 3 Notwithstanding any provisions of this By-law to the contrary, that portion of Lots 32 and 33, Concession 3, designated "SPECIAL PROVISION BY-LAW 83-27 II on the attached Schedule "X" hereto, shall be used only in accordance with the following provisions. The Block numbers cited herein refer to Block Numbers on Schedule "X_l" hereto. (1) Blocks 1, 2, 3 and 4 (a) Permitted Uses one single family dwelling per lot, and uses, buildings and structures accesory thereto. (2) Blocks 5 and 6 (a) Permitted Uses no person shall use, erect, place or alter any building, structure, septic tank or tile bed on, or alter any lands within, that area defined as Blocks 5 and 6. (3) Zone Provisions (i ) (i i ) Lot Area (minimum) 0.5 hectare Lot Frontage (minimum) 42 metres, where lot lines are not parallel, the lot frontage shall be the distance between the side lot lines measured on a line 30 metres back from the front lot line and parallel to it Front Yard (minimum) Interior Side Yard (minimum) Exterior Side Yard (minimum) Rear Yard (minimum) Gross Floor Area (minimum) Building Height 15.0 metres 6.0 metres 15.0 metres 15.0 metres 165.0 sq. metres 10.0 metres" (iii) (i v) (v) (vi) (vi i ) (vi i i ) 2. Schedule "A" to By-law Number 2111, as amended, is hereby further amended by changing to "SPECIAL PROVISION BY-LAW 83- 27 the zone designation of the lands designated "SPECIAL PROVISION BY-LAW 83-27 " on the attached Schedule "X" hereto. This By-law shall come into effect on the date hereof, subject to the provisions of Section 39(11) of the Planning Act.
