THE CORPORATION OF THE TOWN OF NEWCASTLE
BY -LAW 83- 162
being a by-law to amend by-law 79-104
entitled a by-law to provide for the
maintenance, management, regulation and
control of cemeteries in the Town of
Newcastle
WHEREAS the Cemeteries Act R.S.O. 1980 and the Regulations passed thereunder,
establish the rules and regulations governing Cemeteries and the USE thereof;
AND WHEREAS the said Act provides that the owner of a Cemetery may make further
regulations for the laying out and selling of lots, managing the cemetery and
otherwise generally respecting the use of the grounds and for the execution of
conveyance of lots or plots in the cemetery;
AND WHEREAS the Council of the Corporation did by resolution C-823-83 authorize
and grant Mr. Lloyd Stephenson exemption to Section iii 3 (2) and direct the
placement of a monument base exceeding the size permitted by by-law 79-104;
NOW THEREFORE the Council of the Corporation of the Town of Newcastle hereby
enacts as follows:
1) That Mr. Lloyd Stephenson, being the owner of a plot situate in Block 'B',
Lot 13, Bondhead Cemetery, in the former Village of Newcastle, now in the
Town of Newcastle, is hereby granted an exemption to section iii 3 (2) of
by-law 79-104:
2) That Town of Newcastle Cemetery Staff are empowered to instal a monument base
3'6" x 1 '0" within the boundaries of Block 'B', Lot 13, Bond Head Cemetery,
in the former Village of Newcastle, now in the Town of Newcastle, being the
plot owned by Mr. Lloyd Stephenson.
3) That the exemption granted hereby is site specific and relates only to the
lands detailed in the preceeding recital~ and is not intended to be a
general amendment to by-law 79-104.
By-law read a first and second time this 28th day of November, 1983.
By-law read a third time and finally passed this 28th day of November, 1983.
