BY-LAW 83- 115
A By-law to appoint a Chief Administrative
Officer
The Municipal Council of the Corporation of the Town of Newcastle
HEREBY ENACTS AS FOLLOWS:
1. That David S. Johnston is hereby appointed the Chief Administrative
Officer of the Town of Newcastle.
2. That David S. Johnston shall be paid for his services such sum
annually in accordance with the terms and conditions as set out in
Schedule "A" attached hereto.
3. The said appointment shall be in accordance with the terms and
conditions as set out in Schedule "A" attached hereto.

Terms and Conditions of Appointment of
David S. Johnston as Chief Administrative
Officer, Town of Newcastle
The following shall be the terms and conditions of the employment of
David S. Johnston as Administrator, Town of Newcastle, namely:
1. Effective September 26, 1983, David S. Johnston, shall commence
his employment with the Corporation of the Town of Newcastle as
Chief Administrative Officer;
2. The duties and responsibilities of the Chief Administrative Officer
are those established by By-law 77~77, as may be amended from time
to time;
3. David S. Johnston shall be remunerated in accordance with the
Salary Administration POlicy for non-affiliated staff, and his
starting salary will be at Step 2, level 18 ($43,977.00). Salary
adjustments shall be made from time to time in accordance with
the Salary Administration Program;
4. David S. Johnston shall be entitled to not less than three weeks
vacation per annum calculated under the terms of the contract;
5. David S. Johnston shall be entitled to all other employee benefits
enjoyed by all other department heads as may be determined from
time to time;
6. The term of appointment of David S. Johnston, as Chief Administrative
Officer, shall be for a period of two years from September 26, 1983.
Prior to the end of the eighteenth month of the contract, the Town
of Newcastle shall give notice in writing to the employee that it is
Council.s intention to term.inate the employment 0ftheemployee; to
extend the contract for a minimum of two years; or to provide for
the employment of the employee "at the pleasure of Council."
7. Notwithstanding anything in Section 6 contained, either party hereto may
terminate this agreement prior to the expiry of the contract upon six
months prior notice in writing to the other.

I, David S. Johnston, do solemnly promise and declare that I will
truly, faithfully and impartially, to the best of my knowledge
and ability, execute the office of Chief Administrative Officer,
that I will truly, faithfully and impartially, to the best of
my knowledge and ability, execute the offices to which I have
been appointed in this municipality, that I have not received
and will not receive any payment or reward, or promise thereof,
for the exercise of any partiality or malversation or other
undue execution of such office (or offices), and that I have
not by myself or partner, either directly or indirectly, any
interest in any contract with or on behalf of the Corporation
except that arising out of my office as Chief Administrative
Officer.
