THE CORPORATION OF THE TOWN OF NEWCASTLE BY-LAW NUMBER 83-109 being a By-law to amend By-law Number 76-25, as amended, of the Corporation of the Town of Newcastle. WHEREAS the Council of the Town of Newcastle has deemed it advisable from time to time to amend By-law Number 76-25, as amended, in the Town of Newcastle. NOW THEREFORE, the Council of the Corporation of the Town of Newcastle enacts as follows: 1. Section 3, Subsection 29 of By-law 76-25, as amended, is hereby further amended by adding thereto a further Subsection (f) as follows: (f) "SIGN OFFSIGHT DIRECTIONAL" _ means any offsight sign having an area of not more than 1.25 square meters, used to provide in- formation in respect of any event or service of a transitory or impermanent nature. 2. Section 4, Subsection 11, of By-law 76-25, as amended, is hereby repealed in its entirety and replaced with the following new Subsection 11. "(11) OFF-SITE DIRECTIONAL SIGNS _ unless otherwise provided by this By-law, a a maximum of two (2) off-site directional signs may be permitted for anyone business having a sign area of not more than 3.5 square meters each, indicating the name or nature of a business, a public service or an institution and the dir- ections to the lot upon which such business, public service or institution is located, may be permitted within any zoning classification, save and accept residential zones." ...2/ [File No........L9.:...!.~.:.LQL.._....J . Section 4 of By-law 76-25, as amended, is hereby further amended by adding thereto the following new Subsection 14 as follows: "(14) DEVELOPMENT PROMOTION SIGNS - notwithstanding any provision of this by-law to the contrary, development promotion signs may by erected by an owner of lands upon which a development proposal has been approved by the Town of Newcastle in accord- ance with the following provisions: (i) a maximum of four (4) off-site directional signs not exceeding 3.5 square meters in size (ii) a maximum combined total of twelve (12) tempor- ary off-site directional promotion or information signs not exceeding 1.25 square meters in size" (iii) a maximum of one (1) temporary identification sign not exceeding 25 square metres in size. 4. Section 4, Subsection 6 (c) of By-law 76-25, as amended, is hereby further amended by adding thereto the follow- ing words: "Unless a road occupancy permit or written approval has been obtained from the Town of Newcastle Public Works Department or the Road Authority having juriSdiction over such sight triangle." 5. Section 4, Subsection 6 (d) of By-law 76-25, as amended, is hereby further amended by deleting the existing Section 6 (d) in its entirety and replacing it with the following new Subsection 6 (d): "6 (d) - Prohibition in Street Allowances - no sign, other than a wall sign, public use sign, or an off-site directional sign shall be erected within any street allowance. Where one of the afore mentioned signs, save and accept wall signs, are to be located within a street allowance, a road occupancy permit must be obtained from the Town of Newcastle Public Works Department or the Road Authority having juriSdiction over such street. Notwithstanding any provision of this By-law to the contrary, a sign permit wil also be re- quired regardless of sign area of such sign(s). 6. This By-law shall come into effect on the date of pass- ing hereof.
