THE CORPORATION OF THE TOWN OF NEWCASTLE
BY-LAW NUMBER 84- 71
being a By-law to amend Restricted Area By-law 1592, as amended,
of the former Township of Clarke, now in the Town of Newcastle.
WHEREAS the Council of the Corporation of the Town of Newcastle deems
it advisable to amend Restricted Area (Zoning) By-law 1592, as
amended, of the former Township of Clarke in order to permit the
expansion of an existing Highway Commercial use pursuant to Section
16.6.5 of the Durham Regional Official Plan.
NOW THEREFORE, the Council of the Corporation of the Town of
Newcastle enacts as follows:
1. Schedule "A" Map 1 to By-law 1592, as amended, is hereby further
amended by changing to IHC_4" the zone designation of the lands
indicated as "Z0NE CHANGE TO IHC-4" on the attached Schedule "X"
hereto.
2. Section 7.3 of By-law 1592, as amended, is hereby further
amended by adding the following Subsection (d):
"(d) HC-4 Part Lot 28, Concession 4
Notwithstanding any provisions of this By-law to the contrary,
that part of Lot 28, Concession 4, which is designated IHC_4" on
Schedul e "A" hereto may on1 y be used in accordance with the
following provisions:
(i) Permitted Uses
Residential
a single family dwelling, in conjunction with a permitted
Non-Residential use if occupied by the owner, caretaker,
watchman, or other simii1ar person, employed on the lot on which
such dwelling is located, and his family;
a dwelling unit in a Non-Residential building, if occupied by
the owner, caretaker, watchman or other similar person, employed
on the lot on which such dwelling unit is located, and his
f am i 1 y .
Non-Residential
a farmers' co-operative corporation within the meaning of The
The Corporations Act;
- a farm implement dealer;
- a restaurant;
_ a sporting goods service centre;
- a public or municipal garage;
- a hotel;
_ a motel (with or without restaurant facilities);
- a commercial nursery;
_ a fruit and vegetable produce sales outlet; and
_ a recreational vehicle sales and service outlet.
