THE CORPORATION OF THE TOWN OF NEWCASTLE BY-LAW NUMBER 84-~ being a By-law to amend Restricted Area By-law 1592, as amended, of the former Township of Clarke, now in the Town of Newcastle. WHEREAS the Council of the Corporation of the Town of Newcastle deems it advisable to amend Restricted Area (Zoning) By-law 1592, as amended, of the former Township of Clarke in order to identify a rural non-farm related Residential Cluster pursuant to Section 10.2.1.4 of the Durham Regional Official Plan. NOW THEREFORE, the Council of the Corporation of the Town of Newcastle enacts as follows: 1. Schedule IIAII Map 2 to By-law 1592, as amended, is hereby further amended by changing to IIA_1711 the zone designation of the lands indicated as IIZ0NE CHANGE TO A-l7" on the attached Schedule IIXII hereto. 2. Section 10.3 of By-law 1592, as amended, is hereby further amended by adding the following subsection (p): (p) A-17 - Part of Lot 31, Concession 6 Notwithstanding the permitted uses referred to in Section 10.1 hereof, that Part of Lot 31, Concession 6, which is designated IIA_1711 on Schedule IIAII hereto shall be considered a residential cluster and may only be used in accordance with the following provisions: (i) Permitted Uses one (1) single family detached dwelling and buildings and structures accessory thereto. (ii) Zone Provisions (a) Lot Frontage (minimum) 40.0 metres (b) Lot Area (minimum) 4000 sq. metres (c) Front Yard (minimum) 15.0 metres (d) Interior Side Yard (minimum) 6.0 metres (e) Exterior Side Yard (minimum) 15.0 metres (f) Rear Yard (minimum) 15.0 metres (g) Lot Coverage (maximum) 30% of the lot area (h) Setback (minimum) from Arterial Type 'A'Road 33.0 metres all Other Roads 25.0 metres (i ) Floor Area (minimum) 150.0 sq. metres (j) Building Height (maximum) 10.0 metres 3. Schedule IIXII attached hereto shall form part of this By-law. 4. This By-law shall come into effect on the date hereof subject to the provisions of Section 34 of the Planning Act.
