THE CORPORATION OF THE TOWN OF NEWCASTLE BY-LAW NUMBER 84- 5 being a By-law to amend By-law 2111, as amended, of the former Township of Darlington, now in the Town of Newcastle. WHEREAS the Council of the Corporation of the Town of Newcastle deems it advisable to amend By-law 2111, as amended, of the former Township of Darlington, now in the Town of Newcastle. NOW THEREFORE, the Corporation of the Town of Newcastle enacts as fo 11 ows : 1. Section 13 of By-law 2111, as amended, is hereby further amended by adding thereto the following subsection (vv): "(vv) Part of Lot 34, Concession 3 Notwithstanding any provision of this By-law to the contrary, that part of Lot 34, Concession 3, designated as "Special Provision By-law 84- 5 on Schedule A hereto, shall only be used in accordance with the following provisions. In the event that there is any conflict between the provisions of this Special Provision, and any other provisions of this By-law 2111, as amended, then the provisions of this Special Provision shall apply. But in the event that this Special Provision is silent on any matter then the provisions of By-law 2111, as amended, shall apply. The zone designations cited herein, refer to the zone designations identified on Schedule X-1 hereto. (i) Definitions (a) Building: - shall mean a structure, temporary or permanent, having a roof supported by columns or one or more walls which is used for the shelter, accommodation, or enclosure of persons, animals, equipment, goods or materials. Any tent, canopy, bin, bunk, or platform, vessel, vehicle or trailer used for any of the said purposes shall be deemed a building. (b) Dwelling, Street Townhouse: - shall mean one of a group of three or more, but not more than ten attached dwelling units, separated vertically, each of which has an independent entrance and fronts onto an improved public street. (c) Dwelling, Semi-detached: - shall mean a building divided vertically into two separate dwelling units, each of which has an independent entrance directly from the outside of such building. I I File 1I~.......b.Q.,..J.2,...~.IL.........1 - i i - (d) Dwelling, Single-detached: - shall mean a completely detached building contain- ing one dwelling unit and occupied by not more than one fami 1 y. ( e) Lot: - shall mean a parcel or tract of land described in a deed, or other legal document, the title to which is legally conveyable. (f) Park, Public: - shall mean a lot or block of land owned or controlled by a public authority, the main use of which shall be for recreational activities and which may include its use as a playground, or play field, including athletic fields, aquatic facilities, gardens, landscaped areas, and any buildings, the purpose of which shall be for recreation or a use accessory to a recreational use. (g) Park, Greenbelt: - shall mean a lot or block of land, the main purpose of which shall be the protection of open space areas and natural watercourses and which may also be used for recreational activities, including playing and athletic fields, but excluding any buildings or structures. (ii) Permitted Uses (a) URBAN RESIDENTIAL TYPE ONE (Rl) ZONE - single detached dwellings - semi-detached dwellings - public parks (b) URBAN RESIDENTIAL TYPE TWO (R2) ZONE - single detached dwellings - public parks (c) URBAN RESIDENTIAL TYPE THREE (R3) ZONE - street townhouse dwellings - public parks (d) ENVIRONMENTAL PROTECTION (EP) ZONE - conservation area _ reforestration or forestry areas - bird or wildlife sanctuary - greenbelt parks _ stormwater, flood and erosion control facilities , . - iii - (iii) Zone Provisions (a) (i ) URBAN RESIDENTIAL TYPE ONE (Rl) ZONE Lot Area (minimum) - Single Detached - Semi-Detached (ii) Lot Frontage (minimum) - Single Detached (interior lot) - Single Detached (corner lot) _ Semi-Detached (interior lot) - Semi-Detached (corner lot) (iii) Yard Requirements (minimum) - Front Ya rd Exterior Side Yard Interior Side Yard - provided that where an port is not provi ded, side yard on one side - Rear Yard (iv) Dwelling Unit Area (minimum) - Single Detached Dwellings One (1) Storey or Split Level - One and One-half Storey or Two (2) Storey - Semi -Detached (v) Lot Coverage (maximum) - Single Detached - Semi-Detached 465 square metres 550 square metres 15 metres 18 metres 18 metres 20 metres 6 metres 6 metres 1 .25 metres attached garage or car the minimum interior shall be 4.5 metres 1 0 metres 85 square metres 110 square metres 80 square metres 40 percent 45 percent 30 percent 10 metres (vi) Landscaped Open Space (minimum) (vii) Building Height (maximum) (viii) Special Yard Provision Semi-Detached Dwelling _ Notwithstanding the interior side yard requirements above where a semi-detached dwelling is only connected at some point below finished grade, the minimum horizontal distance between such dwelling units shall not be less than 1.25 metres. (ix) No buildings or structures may be erected and no use may be established in the Urban Residential type one (Rl) Zone unless the lot upon which it is situated is serviced by municipal sewage and water systems which have sufficient capacity to accommodate the proposed use. (b) URBAN RESIDENTIAL TYPE TWO (R2) ZONE (i ) Lot Area (minimum) 370 square metres (i i) Lot Frontage (minimum - Interi or Lot 12.2 metres - Corner Lot 16.5 metres (iii) Yard Requirements (minimum) _ Front Yard 6 metres Exterior Side Yard 6 metres _ provided that where an attached garage or car port is not provided, the minimum interior side yard on one side shall be 4.5 metres _ Rear Yard 10 metres - iv - (iv) Dwelling Unit Area (minimum) - Single Detached Dwellings One (1) Storey or Split Level 85 square metres - One and One-half Storey or Two (2) Storey 110 square metres (v) Lot Coverage (maximum) 36 percent (vi) Landscaped Open Space (minimum) 30 percent (vii) Building Height (maximum) 10 metres (viii) No buildings or structures may be erected and no use may be established in the Urban Residential Type Two (R2) Zone unless the lot upon which it is situated is serviced by municipal sewage and water systems which have sufficient capacity to accommodate the proposed use. (c) URBAN RESIDENTIAL TYPE THREE (R3) ZONE REGULATIONS FOR STREET TOWNHOUSE DWELLINGS (i) Lot Area (minimum) - Interi or Lot - Corner Lot 170 square metres 280 square metres (ii) Lot Frontage (minimum) - Interior Lot 6 metres Where an interior lot abutts a residential zone upon which a residential use other than a townhouse dwell- ing unit is situated; or abutts any other zone, the minimum lot frontage shall be 7.5 metres. - Corner Lot 11 metres (iii) Yard Requirements (minimum) - Front Yard 6 metres - Interior Side Yard The minimum interior side yard requirement shall be 1.5 metres where a street townhouse dwelling unit is not attached to an adjoi ni n9 unit. Where an end interior street townhouse dwelling unit abutts a residential zone upon which a residential use other than a townhouse dwelling unit is situated; or abutts any other zone, the minimum interior side yard shall be 3.0 metres. - Exterior Side Yard 4.5 metres - Rear Yard 7.5 metres (iv) Dwelling Unit Area (minimum) (v) Lot Coverage (maximum) (vi) Landscaped Open Space (minimum) (vii) Building Height (maximum) 85 square metres 50 percent 30 percent 10 metres (viii) No buildings or structures may be erected and no use may be established in the Urban Residential Type Three (R3) Zone unless the lot upon which it is situated is serviced by municipal sewage and water systems which have sufficient capactiy to accommodate the proposed use. - v - (ix) SPECIAL EXCEPTIONS - URBAN RESIDENTIAL TYPE THREE (R3) ZONE i) Urban Residential Exception R3-1 Notwithstanding the provisions of Section 1 (iii)c _ "Zone Provisions - Urban Residential Type Three (R3) Zone"; those 1 ands desi gnated as IR3-1" on Schedule "X_l" to this By-law, shall also be subject to the following zone provisions: (a) A maximum of fifteen (15) street townhouse dwelling units ii) Urban Residential Exception R3-2 Notwithstanding the provisions of Section 1 (iii)c _ "Zone Provisions - Urban Residential Type Three (R3) Zone"; those lands designated as IR3-2" on Schedule "X_l" to this By-law, shall also be subject to the following zone provisions: (a) A maximum of eighteen (18) street townhouse dwelling units 2. Map 21 of Schedule A, By-law 2111, as amended, is hereby further amended by changi ng to Speci a1 Provi si on By-1 aw84- 5 ,the zone deSignation of the lands designated Zone Change to Special Provision By-law 84-~ on the attached Schedule X hereto. 3. Schedule X-1 to By-law 84-5 shall form part of this Special Provision. ---- 4. This By-law shall come into effect on the date hereof, subject to the provisions of Section 34 of The Planning Act.
