HomeMy WebLinkAbout84-19 THE CORPORATION OF THE TOWN OF NEWCASTLE BY-LAW 84- 19 being a by-law to authorize the execution of a contract with Grace Player, Judy Davey and Greta Luxton, for the provision of emergency telephone answering services THE COUNCIL OF THE CORPORATION OF THE TOWN OF NEWCASTLE HEREBY ENACTS AS FOLLOWS: 1. THAT the Mayor and Clerk are hereby authorized to execute on behalf of the Corporation of the Town of Newcastle, and seal with the Corporation Seal, an agreement between Grace Player, Judy Davey and Greta Luxton, and the said Corporation, for the provision of emergency telephone answering services for the Fire Department of the Town of Newcastle. By-law read a first and second time this 13 day of February 1984. BET WEE N THE CORPORATION OF THE TOWN OF NEWCASTLE, hereinafter referred to as "Newcastle", OF THE FIRST PART - and - GRACE PLAYER, JUDY DAVEY and GRETA LUXTON, hereinafter referred to as "The Answering Service", OF THE SECOND PART WHEREAS the parties of the second part are providing an emergency telephone answering service for the fire department of the Town of Newcastle; AND WHEREAS the Town of Newcastle has provided the parties of the second part with the necessary equipment to permit them to fulfill their obligations; AND WHEREAS the parties hereto find it desirable to enter into an agreement outlining their duties and obligations; NOW THEREFORE IN CONSIDERATION of the sum of TWO ($2.00) DOLLARS AND OTHER GOOD AND VALUABLE CONSIDERATION THE PARTIES AGREE AS FOLLOWS: 1. The parties of the second part agree to provide a telephone answering service for emergency telephone calls for the following Town of Newcastle fire stations, namely: Bv.law r~ o. m____~_t~..!.1__.._..... ------....- - 2 - Bowmanville Hall No. 1 Newcastle - Hall No. 2 Orono - Hall No. 3 Courtice - Hall No. 4 . 2. The hours during which such telephone answering service shall be provided and the manner in which it shall be provided shall be subject to the direction of the Fire Chief of the Town of Newcastle. 3. Newcastle shall provide the parties of the second part with the necessary equipment to provide the telephone answering service and such equipment shall at all times remain the property of the Town of Newcastle and shall be returned to it in the event of the termination of this contract. 4. The Answering Service shall be remunerated at the rate of $2.34 for each hour the telephone answering service is provided, and the Answering Service shall provide an itemized monthly invoice of services rendered. 5. It is understood and agreed that the parties of the second part are independent contractors and not employees of the Town of Newcastle. 6. This contract shall be for a period of one (1) year and shall expire on the 31st day of December, 1984 unless - 3 - otherwise renewed in writing by the parties. IN WITNESS WHEREOF the Corporation of the Town of Newcastle has hereunto affixed its corporate seal duly attested to by the hands of its proper officers in that behalf and the parties of the secon dpart have hereunto affixed their hands and seals.
