THE CORPORATION OF THE TOWN OF NEWCASTLE
BY-LAW NUMBER 84-16
being a By-law to designate a certain portion of a Registered Plan
as not being subject to Part Lot Control.
WHEREAS the Owner of Part of Lots 4, 5, 6, 27 and 29, of Block 6
of the C.G. Hanning Plan dated the 30th day of June, 1869, and
deposited at the Land Registry Office for the Land Registry
Division of Newcastle (No. 10), has request the Town of Newcastle
to exempt said lands from Section 49 (v) of the Planning Act; and
WHEREAS the Council of the Town of Newcastle is authorized to pass
a by-law pursuant to Section 49(vii) of the Planning Act; and
WHEREAS Council deems it expedient to pass this by-law granting
relief from Part Lot Control with reference to the said lands;

NOW, therefore, the Council of the Corporation of the Town of
Newcastle enacts as follows:
1. That Subsection (v) of Section 49 of the Planning Act shall
not apply to those lands described in Schedule "A" to this
by-law.
2. This by-law shall come into effect upon being approved by the
Regional Municipality of Durham, and thereafter Subsection (v)
of Section 49 shall cease to apply to the lands described in
Schedule "A" hereto.

3. Schedule "A" attached hereto shall form part of this by-law.

SCHEDULE "A" TO BY-LAW 84-16 -.-/
ALL AND SINGULAR that certain parcel or tract of land
and premises situate, lying and being composed of Part of
original Township Lot Eleven in the First Concession of the
Township of Darlington now within the limits of the said Town '
which may be better known as those parts of Town Lots numbered
27 and 29 in Block 6, said Lot 27, fronting on the Northerly
side of Argyle Street in said Town, according to a Plan of
the Town of Bowmanville, on file in the Registry Office for
the Registry Division of the West Riding of the County of
Durham, which Plan was made by C.G. Hanning, P.L.S., and bears
date the 30th day of June, 1869, the said parcel of land hereby
conveyed being more particularly described as follows:
COMMENCING at a point in the Northerly limit of Argyle Street,
said point being at the intersection of the said limit with
a line drawn on a course parallel with the westerly limit
of Lot 27 from the centre line of a brick wall running through
a brick house standing on Lot 27, said pOint being also distant
Easterly 51 feet 7 inches from the South-westerly angle of
said Lot 27;
THENCE Northerly parallel to the said Westerly limit of said
Lot 27, a distance of 26 feet to the centre of said wall;
THENCE Northerly in and along said centreline a distance of
28 feet 5 inches to a jog in said wall~
THENCE Westerly in and along the South face of 2 feet
6 inches to the westerly face of a wall;
THENCE Northerly in and along said westerly limit of said
Lot 27 a distance of 127 feet to a fence said fence being
distant northerly 49 feet 6 inches from the Northerly limit
of said Lot 27;
THENCE westerly parallel to the Northerly limit of Argyle
Street and along the line of a fence, 48 feet 11.25 inches
to the Westerly limit of said Lot 29;
THENCE Southerly in and along the Westerly limits of Lots
29 and 27 along the line of an old fence, 181 feet 6 ~nches
to the south-westerly angle of said Lot 27;
THENCE easterly in and along Southern limit of said Lot 27
a distance of 51 feet 7 inches to the POINT OF COMMENCEMENT.

Township Lot Eleven in the First Concession of the Township
of Darlington now within the limits of the said Town which
may be better known as those parts of Town Lots Numbered 4,
. 5, 6, 27 and 29, in Block Six, said Lots 6 and 27 fronting
on the northerly side of Argyle Street in said Town, according
to a Plan of the Town of Bowmanville on file in the Registry
Office for the Registry Division of the West Riding of the

and bears the date the 30th day of June, 1869, the said parcel
