BY-LAW NUMBER 84-158

"
being a By-law to amend By-law 84-63. Comprehensive Zoning By-law
of the Corporation of the Town of Newcastle.
WHEREAS the Council of the Corporation of the Town of Newcastle deems
it advisable to amend By-law 84-63 of the Corporation of the Town of
Newcastle.
NOW THEREFORE BE IT RESOLVED THAT By-law 84-63 is hereby amended as
follows:
1. Section 6.4.18 "AGRICULTURAL EXCEPTION (A-18) ZONE" is hereby
deleted in its entirety.
2. Section 19.4 is hereby amended by adding thereto the
fOllowing new Subsection 19.4.9 as follows:
"19.4.9
SPECIAL PURPOSE COMMERCIAL EXCEPTION (C4-9) ZONE
Notwithstanding Sections 19.1 and 19.3, those lands zoned C4-9
on the schedules to this By-law may only be used for a meat
cutting and meat smoking operation subject to the following
special zone regulations.
a. Front yard (minimum)
45 metres
b. Minimum setback from any residential
building not located on the same lot
24 metres
For the purposes of this special exception. a meat cutting and
meat smoking operation shall not incl ude an abattoi r".
3. Schedule 1 of By-law 84-63 is hereby amended as follows:
a. by deleting the IA_18" zone designation of Part of Lot 11,
Concession 5. geographic Township of Darlington and
replacing same with a "C4-9" zone designation as shown on
the attached Schedule "X" hereto.
4. This By-law shall come into effect on the date of passing
hereof. subject to the provisions of Section 34 of the Planning Act.

THIS APPEAL having come on for public hearing and after the
hearing, the Board having reserved its decision until this
day;
THE BOARD ORDERS that the appeal to amend Zoning By-law
84-63 as amended by By-law 84-158 is allowed, and the by-law
is further amended in the manner shown as Schedule "A"
attached to this order.

to the order of the Ontario Municipal Board
made on the 28th day of October, 1985
1. By-law 84-63, as amended, is hereby further amended by
adding to Section 6.4 the following new Subsection
6.4.18:
"6.4.18 AGRICULTURAL EXCEPTION (A-18) ZONE"
Notwithstanding Sections 6.1 and 6.3, those lands zoned
"A-18" on the Schedules to this By-law may also be used
for an abattoir containing a refrigerated offal room
and a meat cutting and meat smoking operation subject
to the following zone regulations: .
a.
Lot area (minimum)
45 metres
.
b.
Interior Sideyard (minimum)
(i) Abattoir 30 metres
(ii) Meat Cutting & Smoking Establishment 3 metres
c. Rearyard (minimum)
30 metres
d. Setback of Abattoir from Existing
Residential Dwellings (minimum)
180 metres
e. Ground Floor Area (maximums) - Abattoir 200.00 square
metres
- Meat Cutting & Smoking
Establishment 140.00
square metres

2. By-law 84-63, as amended, is hereby further amended by
deleting Section 19.4.9 in its entirety.
3. Schedule "1" to By-law 84-63, is hereby amended by deleting
the "C4-9" zone designation of Part of Lot 11, Concession 5,
geographic Township of Darlington and replacing same with an
"A-18" zone designation as shoWn on the attached Schedule
"X" hereto.
