THE CORPORATION OF THE TOWN OF NEWCASTLE BY-LAW NUMBERl84- JL being a By-law to amend Restricted Area By-law No. 1587, as amended, of the former Town of Bowmanvi11e, now in the Town of Newcastle. WHEREAS the Council of the Corporation of the Town of Newcat1e deems it advisable to amend Restricted Area By-law 1587, as amended, of the former Town of Bowmanvi11e. NOW THEREFORE, the Council of the Town of Newcastle ENACTS as follows: 1. Schedule II All to By-1 aw 1587, as amended, is hereby further amended by adding the designation IISPECIAL CONDITION 3211 to the zoning designation of the lands indicated as IIZ0NE CHANGE TO SPECIAL CONDITION 3211 on the attached Schedule "X" hereto, and by adding to the lands so indicated cross-hatching and the figure 32 encircled. tit 2. Schedule IIBII to By-law 1587, as amended, is hereby further amended by adding hereto the following SPECIAL CONDITION 32: SPECIAL CONDITION 32 Those lands as shown on Schedule IIAII cross-hatched and marked IISPECIAL CONDITION 32" shall be subject to the special regulations hereinafter contained and where there is any conflict between the regulations hereinafter set out and any provision of By-law 1587, then the provisions of this SPECIAL CONDITION shall apply, but in all other respects the provisions of By-law 1587, as amended, shall apply. The zone designations cited herein, refer to the zone designations identified on Schedule "X-l" hereto. ~ 1.1 DEFINED AREA The area subject to this SPECIAL CONDITION are shown cross-hat~hed with the figure 32 encircled on the attached Schedule "All hereto. 1.2 DEFINITIONS (a) Building: - shall mean a structure, temporary or permanent, having a roof supported by columns or one or more walls which is used for the shelter, accommodation, or enclosure of persons, animals, equipment, goods or materials. Any tent, canopy, bin, bunk~ or platform, vessel, vehicle or trailer used for any of the said purposes shall be deemed a building. Dwelling, Semi-detached: - shall mean a building divided vertically into two separate dwelling units, each of which has an independent entrance directly from the outside of such building. Dwelling, Single-detached: - shall mean a completely detached building containing one dwelling unit and occupied by not more than one family. Park, Public: _ shall mean a lot or block of land owned or controlled by a public authority, the main use of which shall be for recreational activities and which may include its use as a playground, or play field, including athletic fields, aquatic facilities, gardens, landscaped areas, and any buildings, the purpose of which shall be for recreation or a use accessory to a recreational use. Park, Greenbelt: _ shall mean a lot or block of land, the main purpose of which shall be the protection of open space areas and natural watercourses and which may also be used for recreational activities, including playing and athletic fields, but excluding any buildings or structures. 1.3 PERMITTED USES (a) e (b) Urban Residential Type One (Rl) Zone - single detached dwellings - semi-detached dwellings - public parks Environmental Protection (EP) Zone - conservation area _ reforestration or forestry areas - bird or wildlife sanctuary - greenbelt parks _ stormwater, flood and erosion control facilities 1.4 ZONE PROVISIONS e (a) Urban Residential Type One (1) Zone (i) Lot Area (minimum) - Single Detached - Semi-Detached 465 square metres 550 square metres (ii) Lot Frontage (minimum) - Single Detached (interior lot) - Single Detached (corner lot) - Semi-Detached (interior lot) - Semi-Detached (corner lot) (iii) Yard Requirements (minimum) - Front Yard Exterior Side Yard Interior Side Yard - provided that where an port is not provi ded, side yard on one side - Rear Yard 15 metres 18 metres 18 metres 20 metres 6 metres 6 metres 1.25 metres attached garage or car the minimum interior shall be 4.5 metres 10 metres (iv) Dwelling Unit Area (minimum) - Single Detached Dwellings One (1) Storey or Split Level - One and One-half Storey or Two (2) Storey - Semi-Detached 85 square metres 110 square metres 80 square metres - 3 - (v) Lot Coverage (maximum) - Single Detached - Semi-Detached (vi) Landscaped Open Space (minimum) (vii) Building Height (maximum) 40 percent 45 percent 30 percent 10 metres (viii) Special Yard Provision Semi-Detached Dwelling - Notwithstanding the interior side yard requirements above where a semi-detached dwelling is only connected at some point below finished grade, the minimum horizontal distance between such dwelling units shall not be less than 1.25 metres. (ix) No buildings or structures may be erected and no use may be established in the Urban Residential type one (R1) Zone unless the lot upon which it is situated is serviced by municipal sewage and water systems which have sufficient capacity to accommodate the proposed use. e 3.
