HomeMy WebLinkAbout91-55 THE CORPORATION OF THE TOWN OF NEWCASTLE BY-LAN NUMBER 91~55 being a by-law to further amend By-law No. 78-50, as amended, to regulate the holding of certain public entertainments, festivals and parades within the Town of Newcastle WHEREAS the Council of the Corporation of the Town of Newcastle deems it advisable to further amend By-law 78-50, NOW THEREFORE the Council of the Town of Newcastle enacts as follows: 1. By-law No. 78-50, as amended by By-law No. 86-108 and By-law No. 90-114, is further amended by: b) a) amending paragraph 2(b) thereof by adding after the words the "Region of Durham", the words "Police Service"; repealing paragraph 2(c) thereof and replacing it with a new paragraph 2(c) as follows: "2(c) deposit with the Clerk of the Town of Newcastle a certified copy of a comprehensive general liability policy of insurance issued by an insurer licensed to do business in Ontario which provides for limits of protection of $10,000,000.00 in respect of the public entertainment, parade or festival in question, which provides coverage including bodily injury, property damage and non-owned auto insurance, which names the Town of Newcastle as an insured party and which provides coverage for a period equal to the duration of the public entertainment, parade or festival in question plus one (1) day before the commencement and one (1) day after conclusion of the public entertainment, parade or festival, in question"; c) repealing Sections 4, 5, and 6 thereof and replacing them with new Sections 4, 5, and 6 as follows: "4. The fee for licence under this By-law for any public entertainment, parade or festival which is not held for a charitable purpose, is three hundred ($300.00) dollars. 5. Any person who contravenes any provision of this By-law is guilty of an offence. 6. This By-law does not apply to public entertainment, parade or festival which is held or conducted a) on the allowance of a public highway owned by the Town of Newcastle b) on or in a park or recreational facility owned and/or operated by the Town of Newcastle, or c) on or in the Town of Newcastle Administrative Centre, 40 Temperance Street, Bowmanville, Ontario"; and d) renumbering Sections 7 and 8 thereof as Sections 8 and 9, and adding a new Section 7 as follows: By-law 91-55 - 2 - "7. This By-law does not apply to a public entertainment, parade or festival to which By-law No. 91-55 applies and for which a license for an 'exhibition held for hire or gain' within the meaning of By-law No. 91-55 has been issued, so long as such license is not revoked pursuant to By-law No. 91-55". 2. This By-law shall come into full force and effect immediately on the final passing of it. BY-LAW read a first and second time this 29th day of April 1991.
