THE CORPORATION OF THE TOWN OF NEWCASTLE BY-LAW 91- 51 being a by-law to authorize the entering into of an agreement between Courtice Pet Clinic and the Town of Newcastle WHEREAS the Council of the Town of Newcastle passed Resolution *C-160-91 authorizing the Courtice Pet Clinic to issue dog licences on behalf of the Town of Newcastle upon execution of an appropriate agreement setting out certain terms and conditions related to the issuance of the dog licences; NOW THEREFORE BE IT RESOLVED THAT THE COUNCIL OF THE TOWN OF NEWCASTLE ENACTS AS FOLLOWS: 1. THAT the Mayor and Clerk be authorized to execute on behalf of the Corporation of the Town of Newcastle and seal with the Corporate seal, an agreement between Courtice Pet Clinic and the Corporation of the Town of Newcastle, attached hereto as Schedule "A" and forming part of this by-law. SCH~DULE ~AII TO BY-LAW 91-51 DN: SALE.LIe AGREEMENT MADE (IN TRIPLICATE) THIS 25th DAY OF BETWEEN: March 1991 COURTICE PET CLINIC. hereinafter called the "Operator" of the rJl'st part - and - THE TOWN OF NEWCASTLE. hereinafter called the "Municipality" of the second part WHEREAS the Municipality authorizes the Operator to issue dog licenses on behalf of the Municipality; and WHEREAS it is deemed necessary to set out certain terms and. conditions related thereto; NOW THEREFORE, in consideration of the mutual agreements and covenants hereinafter contained, the parties hereto agree as follows: 1. The Operator agrees to issue dog licenses on behalf of the Municipality in accordance with procedures as prescribed by the By-law Enforcement Officer. 2. The Municipality agrees to reimburse the Operator the sum of Two Dollars ($2.00) for every dog licence sold. 3. The Operator agrees to submit to the By-law Enforcement Officer on a bi-weekly basis the following: a) list of names of dog owners, addresses, licence numbers, fee charges, and other pertinent information as required by the By-law Enforcement Oftlcer; and b) all money coIlec:ted from the sales of dog licenses minus the commission fee referred to in Paragraph 2. 4. The parties agree that this Agreement can be cancelled by either party within one (1) month of receipt of written notice to terminate.
