THE CORPORATION OF THE TOWN OF NEWCASTLE BY-LAW NUMBER 91-.124 being a By~law to amend By-law 84-63, the Comprehensive Zoning By~law for the Corporation of the Town of Newcastle. WHEREAS the Ontario Municipal Board under appeal by the Participation House Project of rezoning application DEV 90-049 within the Town of Newcastle orders the Town of Newcastle to amend By-law 84-63, as amended of the Corporation of the Town of Newcastle as follows: NOW THEREFORE BE IT RESOLVED THAT the Town of Newcastle enacts as follows: 1. Section 14.6 "Special Exception - Urban Residential Type Three (R3)" zone is amended by adding thereto the following new Special Exception 14.6.9 as follows: Notwithstanding Section 14.1 and 14.4, the lands zoned "R3-9" on the attached Schedule "A" in addition to the other uses permitted in "Urban Residential Type Three (R3)" zone shall permit one or more stacked townhouse dwelling units which shall be subject to the following .zone regulations. i) a) Dwelling Units (maximum) 39 stacked townhouse units b) Lot Area (minimum) 0.8 hectares c) Lot Frontage (minimum) 100 metres d) Front Yard (minimum) 7.5 metres e) Side Yard (minimum) 7.5 metres f) Rear Yard (minimum) 7.5 metres g) Separations between buildings or structures minimum 2.5 metres h) Separation between walls containing a habitable room window and any private driveway, road or lane (minimum) 4.5 metres Separation between structures or walls without a habitable room window and any private driveway, road or lane (minimum) 1.5 metres j) Dwelling Unit Area (minimum) 83.5 square metres k) Lot Coverage (minimum) 25 percent I) Landscaped Open Space (minimum) 45 percent m) Building Height (maximum) 10.5 metres n) Parking Space 2.0 spaces per dwelling unit 2. Schedule "3"to By-law 84-63, as amended, is hereby further amended as per Schedule "A" attached hereto by changing the zone designation from: "Urban Residential Exception (R1-8)" zone to "Urban Residential Exception (R3-9)" zone and "Urban Residential Exception (RI-8)" zone to "Environmental Protection (EP)" zone. 3. Schedule" A" attached hereto shall form part of this By-law. 4.
