HomeMy WebLinkAbout91-147 THE CORPORATION OF THE TOWN OF NEWCASTLE BY-LAW 91-147 being a By-law respecting the expropriation of certain land required for the widening and improvement of Mearns Avenue in the Town of Newcastle WHEREAS the Town of Newcastle requires certain land for the purpose of widening and upgrading a portion of Mearns Avenue; WHEREAS the Expropriations Act, R.S.O. 1980, c.148, as amended, provides for the expropriation of land where its acquisition is authorized by law; WHEREAS at its meeting on March 11, 1991, Council approved Recommendation #GPA-149-91, as amended, which provides among other things that appropriate Town officials take the necessary action to initiate and proceed with expropriation' of the necessary land from the Bowmanville Zoo for the widening of Mearns Avenue; WHEREAS Council authority is required to be given to execute certain Forms provided for in the Regulations made under the Expropriations Act; NOW THEREFORE THE CORPORATION OF THE TOWN OF NEWCASTLE enacts as follows: 1. THAT the Mayor and Clerk be authorized to execute Form 1 contained in the Regulations made under the provisions of the Expropriations Act R.S.O. 1980, c.l48, as amended, to authorize the Town of Newcastle to apply for approval to expropriate certain lands located on the easterly side of Mearns Avenue running northerly from King Street (Highway No.2) which are more particularly described as Parts 1, 2, 3 and 4 shown on Plan of Survey of Record deposited in the Land Registry Office for the Land Registry Division of Newcastle (No. 10) as Plan 10R-3915 for the purpose of widening Mearns Avenue so that the portion of Mearns Avenue in question may be reconstructed to a 2 lane urban roadway cross section including the replacement of an existing steel culvert located approximately 55 metres north of King Street. 2. THAT the Clerk is authorized to execute Form 2 provided for in the Regulations made under the provisions of the Expropriations Act to give notice of application for approval to expropriate the lands referred to in Section 1 of this By-law.
