THE CORPORATION OF THE TOWN OF NEWCASTLE
BY-LAW 91-131
being a by-law to authorize the execution of
an agreement with Ontario Hydro for providing
an easement in Solina Park
THE COUNCIL OF THE CORPORATION OF THE TOWN OF NEWCASTLE
HEREBY ENACTS THE FOLLOWING:
THAT the Mayor and Clerk are hereby authorized to
execute on behalf of the Corporation of the Town of
Newcastle and seal with the Corporate Seal, an
agreement with Ontario Hydro for the purpose of
providing an easement in Solina Park a copy of which is
attached as Schedule "A"
BY-LAW read a first time this 29th day of July 1991.
BY-LAW read a second time this 29th day of July 1991.
BY-LAW read a third time and finally passed this 29th
day of July 1991.

Witnesseth:
1. THE Owner is the owner in fee simple and in possession of Lot PAe:r.1 '2.. ~

2. Ontario Hydro has erected, or is about to erect, a line for the transmission of power on or adjacent to the said lands.
3. IN CONSIDERATION of the sum of

of lawful money of Canada, paid by Ontario Hydro to the Owner, the Owner hereby grants and conveys in perpetuity to Ontario Hydro,
its successors and assigns, the right to install and maintain (including necessary repairs or replacements) of\.) t:
anchors, with wires attached thereto, upon the said land, as shown on the sketch attached hereto as Schedule "A", and to enter on the
land at any time or times by its servants, agents or workmen for any of the above purposes.
4. THE Owner covenants and agrees not to erect any buildings, structures, or other obstructions of any nature whatever, or pile
materials of any kind, which may interfere with the safe and efficient operation and maintenance of the anchors and wires attached
thereto.
5. THE Owner covenants with Ontario Hydro that he has the right to convey the said rights over the said land to Ontario Hydro,
and that Ontario Hydro shall quietly possess and enjoy the said rights, and that he will execute such further assurances of the said rights
as may be requisite.
6. ALL covenants herein contained shall be construed to be several as well as joint, and wherever the singular and the masculine are
used in this Agreement, the same shall be construed as meaning the plural or the feminine or neuter where the context of the parties
hereto so require.
7. THE burden and benefit of this Agreement shall run with the land and shall extend to, be binding on and enure to the benefit of the
parties hereto and their respective heirs, executors, administrators, successors, and assigns.
