HomeMy WebLinkAbout91-115 THE CORPORATION OF THE TOWN OF NEWCASTLE BY-LAW 91- 115 Being a by-law to stop-up and close and to authorize the sale of part of the opened road allowance described as Devitts Lane, in part of Town Lots 8 and 9, according to the Queen's Block Plan of Part of Lot 12, in the First Concession of the former Town of Bowmanville, now within the limits of the Town of Newcastle, more particularly described as Parts 2 and 3 on Plan 10R-3753. WHEREAS the Corporation of the Town of Newcastle deems it desirable to stop up and close the road known as Devitts Lane and authorizes the sale of said road described as Parts 2 and 3, on Plan 10R-3753 to the abutting owners in accordance with the Municipal Act, R.S.O. 1980, c.302, s.316. WHEREAS notice of the intention of Council to pass this by-law was sent to the Regional Municipality of Durham on the 10th day of August 1990., and the Regional Municipality of Durham granted approval of the proposed by-law by S letter dated the 6th day of S~ptember 1990. NOW THEREFORE BE IT ENACTED AND IT IS HEREBY ENACTED AS A BY-LAW OF THE CORPORATION OF THE TOWN OF NEWCASTLE AS FOLLOWS: 1. Part of that portion of Devitts Lane comprising all and singular that certain parcel and tract of land and premises, lying and being in the Town of Newcastle, in the Regional Municipality of Durham, Province of Ontario, and being composed of the road allowance described as Devitts Lane, being Part of Lots 8 and 9, according to the Queen's Block Plan of Part 12, Concession 1, formerly the Town of Bowmanville, more specifically described as Parts 2 and 3 on Plan 10R-3753 deposited in the Land Registry Office for the Registry Division of Newcastle (No.10) on July 24, 1990, is hereby stopped up and closed. 2. All those portions of the closed road referred to in Section 1, are hereby authorized to be conveyed by the Corporation of the Town of Newcastle as follows: Part 3, Plan 10R-3753 to Mr. & Mrs. William Whyte Part 2, Plan 10R-3753 to Goodyear Canada Inc. By-law read a first time this 15tg day of July 1991. By-law read a second time this :1:5th day of dylty 1991. By-law read a third time and finally p ssed this 15th of Jyly 1991. MAYOR ;/ ./
