THE CORPORATION OF THE TOWN OF NEWCASTLE BY-LAW NUMBER 91-106 being a By-law to amend By-law 84-63, the Comprehensive Zoning By-law for the Corporation of the Town of Newcastle. WHEREAS the Council of the Corporation of the Town of Newcastle deems it advisable to amend By-law 84-63, as amended, of the Corporation of the Town of Newcastle to implement Application Dev 91-018. NOW THEREFORE BE IT RESOLVED THAT the Council of the Corporation of the Town of Newcastle enacts as follows: 1. Section 12.4 "Special Exception - Urban Residential Type One (R1)" zone is hereby amended by adding thereto the Special Exception 12.4.31 as follows: "12.4.31 Notwithstanding Section 12.1, only a semi-detached dwelling may be permitted on those lands zoned R1-31 on the Schedules to this by-law. The placement of buildings and structures shall be subject to the zone regulations as set out in Section 12.2. For the purposes of this provision, a semi-detached dwelling shall mean a building separated vertically into two separate dwelling units, connected underground by footing and foundation, each of which has an independent entrance directly from the outside of the building and each of which is located on a separate lot." 2. Schedule "3" to By-law 84-63 as amended, is hereby further amended by changing the zone designation on the land identified in Schedule "A" from: "Agricultural (A)" to "Holding - Urban Residential Exception ((H)R1-31)" 3. Schedule "A" attached hereto shall form part of this By-law. 4. This By-law shall come into effect on the date of the passing hereof, subject to the provisions of Section 34 of the Planning Act.
