THE CORPORATION OF THE TOWN OF NEWCASTLE BY-LAW NUMBER 90- 83 .. being a By-law to amend By-law 84-63, the Comprehensive Zoning By-law for the Corporation of the Town of Newcastle. WHEREAS the Council of the Corporation of the Town of Newcastle recommends to the Region of Durham for approval of draft Plan of Subdivision 18T-88046; WHEREAS the Council of the Corporation of the Town of Newcastle deems it advisable to amend By- law 84-63, as amended, of the Corporation of the Town of Newcastle to implement draft Plan of Subdivision. NOW THEREFORE BE IT RESOLVED THAT the Council of the Corporation of the Town of Newcastle enacts as follows: 1. Section 15.4 Special Exception - Urban residential Type Four (R4) zone is hereby amended by adding thereto the following new Special Exception 15.4.10 as follows: "15.4.10 URBAN RESIDENTIAL EXCEPTION (R4-10) ZONE Notwithstanding Section 15.2, those lands zoned "(R4-10)" on the Schedules to this By-law are also subject to the following zone regulations: a) Minimum setback from the Canadian Pacific Railway property line 30.0 metres" 2. Schedule "3" to By-law 84-63, as amended, is hereby further amended by changing the zone designation from: "Agricultural (A)" to "Holding - Urban Residential Type One ((H)R 1)" "Environmental Protection (EP)" to "Holding - Urban Residential Type One ((H)R I)" "Agricultural (A)" to "Holding - Urban Residential Exception ((H)R 1-20)" "Agricultural (A)" to "Holding - Urban Residential Type Two ((H)R 2)" "Environmental Protection (EP)" to "Holding - Urban Residential Type Two ((H)R 2)" "Agricultural (A)" to "Holding - Urban Residential Type Three ((H)R 3)" "Agricultural (A)" to "Holding - Urban Residential Type Four ((H)R 4)" "Agricultural (A)" to "Holding - Urban Residential Exception ((H)R 4-10)" "Agricultural (A)" to "Holding - Convenience Commercial ((H)C 2)" "Agricultural (A)" to "Environmental Protection (EP)" as shown on the attached Schedule "A". 3. Schedule "A" attached hereto shall form part of this By-law. 4. This By-law shall come into effect on the date of the passing hereof, subject to the provisions of Section 34 of the Planning Act.
