HomeMy WebLinkAbout90-188 4 ..~.,... ~.-4 , THE CORPORATION OF THE TOWN OF NEWCAS'l'LE BY-LAW 90-188 being a by-law to designate the property municipally known as ."The William Werry House", located in Part of Lot 14, Concession 6, former Township of Clarke, now in the Town of Newcastle, Regional Municipality of Durham, known as and referred to as R.R. #1, Kendal, as a property of architectural and historical value and interest which property is more particularly described in Schedule A attached. WHEREAS the Ontario Heritage Act, 1974 authorizes the Council of a municipality to enact by-laws to designate real property including all the buildings and structures thereon to be of architectural and historical interest; and WHEREAS the Council of the Corporation of the Town of Newcastle has caused to be served upon the owner of the lands and premises known as "The William Werry House", located in Part of Lot 14, Concession 6, former Township of Clarke, now in the Town of Newcastle and upon the Ontario Heritage Foundation, Notice of Intention to Designate the aforesaid real property and has caused such notice of intention to be published in the Orono Times, a newspaper having a general circulation in the area of the designation, once each week for three consecutive weeks, namely September 26, October 3 and October 10, 1990; and WHEREAS "The William Werry House", in Part of Lot 14, Concession 6, former Township of Clarke, now in the Town of Newcastle, Regional Municipality of Durham has a very significant architectural value of interest to the Town of Newcastle and its people in that this well maintained house, believed to have been built C. 1862, is a good example of the stone farmhouses being built in Clarke Township in the mid 19th century. The exterior has undergone few changes. Interior renovations were carried out a number of years ago under the direction of the eminent restoration architect, the late Napier Simpson and retains the following features which are specifically designated as being of architectural value: the random-coursed granite facade and uncoursed rubble work of the side and rear wing remain in good condition; the windows of the front wing retain the original lintels; and the original eaves returns and cornice mouldings remain intact; and WHEREAS the Local Architectural Conservation Advisory Committee of the Town of Newcastle has recommended that the property "The William Werry House", Part of Lot 14, Concession 6, former Township of Clarke, now in the Town of Newcastle, Regional Municipality of Durham, be designated under the terms of the Ontario Heritage Act; and WHEREAS no notice of objection to the proposed designation has been served upon the Clerk of the Municipality; . ... ~ . e .... Yo .. NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF NEWCASTLE HEREBY ENACTS AS FOLLOWS: 1. There is designated as being of Architectural and Historical value of interest, the real property known municipally as "The William Werry House", Part of Lot 14, Concession 6, former Township of Clarke, now in the Town of Newcastle, Regional Municipality of Durham. 2. The Municipal Solicitor is hereby authorized to cause a copy of this by-law to be registered against the property described in the preceeding paragraph. 3. The Town Clerk is hereby authorized to cause a copy of this by-law to be served upon the owners of the aforesaid property and on the Ontario Heritage Foundation, and to cause notice of the passing of this by-law to be published in the Orono Times, a newspaper having general circulation in the area of the designation, once each week for three consecutive weeks. O. 1973 c. 78 amalgamated The Corporation of the Town of Bowmanville, The Corporation of the Village of Newcastle, The Corporation of the Township of Clarke and The Corporation of the Township of Darlington as a town municipality bearing the name The Corporation of the Town of Newcastle on January 1, 1974. The Corporation of the Town of Newcastle therefore became the successor in law of The Corporation of the Township of Clarke on January 1, 1974. By subsection 1(2) of the Regional Municipality of Durham Amendment Act (Newcastle- Clarington), 1993, S. O. 1993 c. 3, on July 1, 1993, The Corporation of the Town of Newcastle was confirmed as a town municipality under the name of The Corporation of the Municipality of Clarington. Subsection 4(1) of this Act deemed all references to The Corporation of the Town of Newcastle or to the Town of Newcastle in any other Act, regulation, by-law, resolution, agreement or other document to be references to The Corporation of the Municipality of Clarington and to the Municipality of Clarington respectively.
