THE CORPORATION OF THE TOWN OF NEWCASTLE
BY-LAW 90-186
being a by-law to designate the property municipally
known as "The Samuel McLellan House", located in
Part of Lot 25, Concession 1, former Township of
Darlington, now in the Town of Newcastle, Regional
Municipality of Durham, known as and referred to as
1909 Bloor Street East, R.R. #2, Bowmanville, as a
property of architectural and historical value and
interest which property is more particularly
described in Schedule A attached.
WHEREAS the Ontario Heritage Act, 1974 authorizes the Council of
a municipality to enact by-laws to designate real property
including all the buildings and structures thereon to be of
architectural and historical interest: and
WHEREAS the Council of the Corporation of the Town of Newcastle
has caused to be served upon the owner of the lands and premises
known as "The Samuel McLellan House", located in Part of Lot 25,
Concession 1, Former Township of Darlington, now in the Town of
Newcastle and upon the Ontario Heritage Foundation, Notice of
Intention to Designate the aforesaid real property and has caused
such notice of intention to be published in the Canadian
Statesman, a newspaper having a general curculation in the area
of the designation, once each week for three consecutive weeks,
namely September 26, October 3 and October 10, 1990: and
WHEREAS "The Samuel McLellan House", in Part of Lot 25,
Concession 1, Former Township of Darlington, now in the Town of
Newcastle, Regional Municipality of Durham, has a very
significant architectural value of interest to the Town of
Newcastle and its people in that the 1 1/2 storey centre-gable
house is an excellent example of the type of fieldstone farmhouse
being built in Darlington Township in the mid 19th century.
Specifically designated as being of architectural value are the
following features: the random-coursed granite exterior which
remains in excellent repair, and in some places retains the
original tooled and scribed pointing: the cornice mouldings and
eaves returns which remain intact; the centre gable which
contains a Gothic window: lacy gingerbread: and a finial and
pendant and the original shutters and most of the original sash
which remain. The existing verandah dates from 1906, but is
perfectly in scale with the house; its pediment echoes the peak
of the gable above. The house was originally surrounded on three
sides by a verandah with a sweep roof and lacy trelliage; and
WHEREAS the Local Architecturalponservation Advisory Committee
of the Town of Newcastle has recommended that the property "The
Samuel McLellan House", Part of Lot 25, Concession 1, Former
Township of Darlington, now in the Town of Newcastle, Regional
Municipality of Durham, be designated under the terms of the
Ontario Heritage Act: and
WHEREAS no notice of objection to the proposed designation has
been served upon the Clerk of the Municipality;

NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF
NEWCASTLE HEREBY ENACTS AS FOLLOWS:
1. There is designated as being of Architectural and Historical
value of interest, the real property known municipally as
"The Samuel McLellan House", Part of Lot 25, Concession 1,
Former Township of Darlington, now in the Town of Newcastle,
Regional Municipality of Durham.
2. The Municipal Solicitor is hereby authorized to cause a copy
of this by-law to be registered against the property
described in the preceeding paragraph.
3. The Town Clerk is hereby authorized to cause a copy of this
by-law to be served upon the owners of the aforesaid
property and on the Ontario Heritage Foundation, and to
cause notice of the passing of this by-law to be published
in the Canadian Statesman, a newspaper having general
circulation in the area of the designation, once each week
for three consecutive weeks.
By-law read a first and second time this 12th day of November
1990.
By-law read a third time and finally passed this 12th day of
November 1990.

SCHEDULE A
ALL AND SINGULAR that certain parcel or tract of land and
premises situate, lying and being in the Town of Newcastle
(formerly Township of Darlington) Regional Municipality of Durham
and being composed of part of Lot 25 in the First Concession of
the Township of Darlington, containing by admeasurement 15 acres
more or less and more particularly described as follows:
Premising that the north limit of said lot 25 has a
bearing of north 72 degrees 15 minutes 40 seconds east
and relating all bearings herein thereto commencing at the
north-east angle of said lot 25.

Paragraph 2 (1)(0) of the Regional Municipality of Durham Act, 1973, S. 0. 1973 c. 78
amalgamated The Corporation of the Town of Bowmanville, The Corporation of the
Village of Newcastle,.The Corporation of the Township of Clarke and The Corporation of
the Township of Darlington as a town municipality bearing the name The Corporation of
the Town of Newcastle on January 1, 1974- The Corporation of the Town of Newcastle
therefore became the successor in law of The Corporation of the Township of Clarke on
January 1, 1974.
By subsection 1(2) of the Regional Municipality of Durham Amendment Act(Newcastle-
Clarington), 1993, S. 0. 1993 c. 3, on July 1, 1993,The Corporation of the Town of
Newcastle was confirmed as a town municipality under the name of The Corporation: of
the Municipality of Clarington. Subsection 4(1) of this Act deemed all references to The
Corporation of the Town of Newcastle or to the Town of Newcastle in any other Act,
regulation, by-law, resolution, agreement or other document to be references to The
Corporation of the Municipality of Clarington and to the Municipality of Clarington
respectively.
