being a by-law to authorize the execution
of Supplementary Agreement 123 with Ontario
Hydro (Advancement of Improvements to
Recreational and Community Use Facilities
at Courtice West Public School in the
Town of Newcastle)
THE COUNCIL OF THE CORPORATION OF THE TOWN OF NEWCASTLE HEREBY
ENACTS AS FOLLOWS:
THAT the Mayor and Clerk are hereby authorized to execute on
behalf of the Corporation of the Town of Newcastle and Seal with
the Corporation Seal, Supplementary Agreement #23, Advancement
of Improvements to Recreational and Community Use Facilities at
Courtice West Public School in the Town of Newcastle, a copy of
which is attached as Schedule "X.II
By-law read a first and second time this 11th day of January 1988

THE TOWN OF NKWCASTLK

Hereinafter referred to as the "CORPORATION"

Hereinafter referred to as the "TOWN"

Hereinafter referred to as the "RIG ION"
OF THI THIRD PART
WHIRIAS the Corporation and the Town have entered into an Agreement
(hereinafter referred to as the Newcastle Agreement), with respect to the
social, economic and financial impacts arising out of the construction
and operation of the Darlington Generating Station (hereinafter referred
to as the Station) on the Town dated March 22, 1977;

AND WHIREAS the Corporation, the Region and the Town have entered into
the Agreement (hereinafter referred to as the Regional Agreement) with
respect to the social, economic and finanoial impaots arising out of the
construotion and operation of the Station on the Region and the Town,
dated August 8, 1977;
AND WHEREAS the Newoastle Aareement and the Regional Agreement provide
for the entering into of supplementary agreements between the
Corporation, the Town and the Region;

AND WHIRIAS the Corporation, the Town and the Region have entered into a
Supplementary Agreement entitled Community Impact Monitoring Program
which involves collecting and updating data on certain impact items whioh
may be affected by the oonstruction and operation of the Station;
AND WHIREAS the Newoastle Agreement provides that the Corporation agree8
to compensate the Town for those finanoial impaots undergone by the Town
as a result of the oonstruotion of the Station which inolude the cost of
advancing oommunity faoilities and providing oommunity servioes;
AND WHERIAS the Corporation, the Town and the Region agree that due to
increased population inflow related to Darlington Generating Station, the
Town has experienoed and anticipates experiencing future additional
service demands in the Court1ce area for recreational and oommunity use
faoilities, necessitating new expanded community use and recreational
facilities in the Court ice Weet Public School;

AND WHEREAS the Corporation, th~ Region and the Town agree that the Town
and the Northumberland and Newcastle Board of Education have undertaken
initiativ.. to advano. i.prov...nt. to oo..unity u.. and r.or.ational
facilities in the Courtice area, inflow of Darlington oonstruction
workers and their families;
NOW THEREFORE, WITNESSETH that in consideration of the covenants
hereinafter oontained and for other good and valuable consideration, the
Corporation, the Town and the Region hereby agree as follows:
( 1. The Corporation agrees to pay to the Town $150,000.00 froll Station
Aooount 'B~ as olaim for payment in full of the financial impaot
incurred by the Town and the Northumberland and Newcastle Board
of Iducation in providing recreational and community use faoilities
in the Court ice West Public School area.
2. Payment will be made to the Town upon presentation to the
Corporation of an invoice for '150,000.00 and supporting

IN WITNESS WHERIOF the Corporation, the Town and the Region have caused
this Agreement to be executed by the affixing of the Corporate seals
attested by the signatures of their proper officers duly authorized in
that behalf.
