THE CORPORATION OF THE TOWN OF NEWCASTLE
BY-LAW NUMBER 88- 21
being a By-law to authorize an amendment to an Agreement between veltri and Son
Limited and the Corporation of the Town of Newcastle.
The Council of the Corporation of the Town of Newcastle hereby enacts as
follows:
1. THAT the Mayor and Clerk are hereby authorized to execute on behalf of
the Corporation of the Town of Newcastle, and seal with the Corporation's seal,
an amendment to a Subdivision Agreement between veltri and Son Limited and
the said Corporation dated the day of , 1988, in the form
attached hereto as Schedule "X".
2. THAT Schedule "X" attached hereto forms part of this By-law.

AMENDING AGREEMENT MADE (in quintuplicate) this 71X day of ~ 1988
BE'lWEEN:
THE CORPORATION OF THE TOWN OF NEWCASTLE,
hereinafter called the "MUNICIPALITY" OF THE FIRST PART
- and -
VELTRI AND SONS CORPORATION,
hereinafter called the "OWNER" OF THE SECOND PART
WITNESSETH THAT:
WHEREAS the lands affected by this Agreement which are described in Schedule
"A" hereto, are hereinafter called the "Lands";
AND WHEREAS the OWner warrants that it is the registered OWner of the said
lands;
AND WHEREAS the Town has passed By-law 86-20 and the OWners and the Town have
duly executed a Subdivision Agreement pursuant to said by-law on July 30, 1986,
which Agreement is registered in the Registry Office, Registry Division of
Newcastle (NO. 10) on the 26th day of August, 1986 as Instrument Number 4879;
AND WHEREAS, in consideration of the OWner's request, the Council of the Town of
Newcastle has resolved to approve an amendment to the aforesaid Agreement;
AND WHEREAS the parties hereto agree to amend said Subdivision Agreement;
NOW THEREFORE, in consideration of the mutual agreements, covenants and
promises contained herein, the parties hereto agree as follows:
1. Paragraph 4.9 of the Subdivision Agreement between the Corporation of the
Town of Newcastle and veltri and Sons Corporation registered in the Registry
Office for the Land Registry Division of Newcastle (No. 10) as Instrument Number
4879, is hereby amended by deleting Subsection (3) and adding the following new
Subsection (3):

"THAT the Owner hereby covenants and agrees that, prior to issuance of 00
building permits, in respect of Lots 29 to 34 inclusive and Lots 4~to 54
inclusive, Phase II as shown on Schedule "B-2" attached hereto, and prior
to the issuance of building permits in respect of Lots 29 to 30
inclusive, Phase III as shown on Schedule "B-3" attached hereto, to
register on title of each affected lot and include within any Agreements
of Purchase and Sale, a "warning Clause" acknowledging that the OWner and
future Owners are fully aware of the existence of farming operations
nearby and will not object, complain, or seek legal action against such
nuisances and noise and odour resulting from normal farming practices."
