THE CORPORATION OF THE TOWN OF NEWCASTLE
BY-LAW 87-79
being a by-law to authorize the entering into
of an agreement with Mr. Lorne Butterfield
respecting the conditions attached to the
issuing of a building permit
THE COUNCIL OF THE CORPORATION OF THE TOWN OF NEWCASTLE HEREBY ENACTS AS FOLLOWS:
1. THAT the Mayor and Clerk are hereby authorized to execute on
behalf of the Corporation of the Town of Newcastle and seal with
the Corporation Seal, an Agreement between Mr. Lorne Butterfield
and the said Corporation, establishing the special conditions
under which a buiVding permit will be issued, a copy of the
Agreement is attached hereto as Schedule IIA".

BETWEEN:
THE CORPORATION OF THE TOWN OF NEWCASTLE
hereinafter referred to as THE CORPORATION
and
LORNE BUTTERFIELD
hereinafter referred to as THE OWNER
WHEREAS the owner is the registered owner of Part of Lot 6, Concession 8, Town
of Newcastle (former Township of Darlington) containing about 50 acres more or less
and described more particularly in Schedule IIA" attached hereto;
AND WHEREAS there is presently constructed on the said land a 16' x 48' storage
facility hereinafter referred to as the "faciliti' with temporary living
quarters above;
AND WHEREAS the owner does not use or permit to be used the said "facility" as
living quarters on a regular or permanent basis;
AND WHEREAS the owner is desirous of obtaining a bUilding permit for the
construction of a single family dwelling on the said lands;
IT IS HEREBY AGREED AS FOLLOWS:
1. The owner shall use the living Quarters in the existing facility as temporary
living quarters until such time as a single family dwelling is constructed on
the said lands.
2. When the single family dwelling is ready for occupancy the use of the pre-
existing facility as temporary living Quarters shall cease and the use of the
facility shall revert totally to a use ancilliary to the orchard operation on
the said lands.
3. Upon occupancy of the single family dwelling, to be constructed, this single
family dwelling will be the only residential use permitted on the said lands.
4. This agreement shall enure to the benefit of and be binding upon all of the
parties hereto its, his or her respective heirs, executors, administrators,
successors or assigns.
