BY-LAW 87- 6
being a by-law to authorize the execution
of Supplementary Agreement #18, with Ontario
Hydro (Advancement of Improvement$ to the
library System)
THE COUNCIL OF THE CORPORATION OF THE TOWN OF NEWCASTLE HEREBY
ENACTS AS FOLLOWS:
THAT the Mayor and Clerk are hereby authorized to execute on
behalf of the Corporation of the Town of Newcastle, and Seal
with the Corporation Seal, Supplementary Agreement #18,
between Ontario Hydro and the said Corporation, in respect
of Advancement of Improvemen~to the Library System. a copy
of which is attached as Schedule "X".
By-law read a first and second time this 12th day of January 1987
By-law read a third time and finally passed this 12th day of January 1987

ADVANCEMENT OF IMPROVEMENTS TO THE LIBRARY SYSTEM

Hereinafter referred to as the "Corporation"
OF THE FIRST PART

Hereinafter referred to as the "Town'.'
OF THE SECOND PART

THE REGIONAL MUNICIPALITY OF DURHAM
Hereinafter referred to as the "Region"
OF THE THIRD PART
Whereas the Corporation and Town have entered into an Agreement
(hereinafter referred to as the Newcastle Agreement), with respect
to the social, economic and financial impacts arising out of the
construction and operation of the Darlington Generating Station
(hereinafter referred to as the Station) on the Town dated
March 22, 1977;
AND WHEREAS the Corporation, the Town and the Region have entered
into an Agreement (hereinafter referred to as the Regional

Agreement) with respect to the social, economic and financial
impacts arising out of the construction and operation of the
Station on the Town and the Region, dated August 8, 1977;
AND WHEREAS the Newcastle Agreement and the Regional Agreement
provide for the entering into of supplementary agreements between
the Corporation, the Town and the Region;
AND WHEREAS the Corporation, the Town and the Region have entered
into a Supplementary Agreement entitled Community Impact Monitoring
Program which involves collecting and updating data on certain
impact items which may be affected by the construction and
operation of the Station;
AND WHEREAS the Newcastle Agreement provides that the Corporation
agrees to compensate the Town for those financial impacts
undergone by the Town as a result of the construction of the
Station which include the cost of advancing community facilities
and providing community services;
AND WHEREAS it is seen that the social and cultural facilities
and services of the Town of Newcastle are subject to an impact
due to the increase in demand placed upon them by the growing
inflow of Darlington construction workers and their families,
it is deemed necessary to advance funds to improve these services
and facilities;

AND WHEREAS the Corporation, the Town and the Region agree that
the Town has undertaken initiative to advance improvements to
its Library services;
NOW, THEREFORE, WITNESSETH that in consideration of the covenants
hereinafter contained and for other good and valuable consideration,
the Corporation, the Town and the Region hereby agree as follows:
1. The Corporation agrees to pay to the Town from Station
Account "B" an amount not to exceed $86,600.00 in respect
of the present and future financial impact to be incurred
by the Town by advancing capital improvements in the nature
of book acquisition and shelving to the Town's Library
services. The total sum of $86,600.00 shall be paid in
three installments to the Town as follows: December 1986 -
$27,470.00; March 1987 - $28,844.00; and March 1988 - $30,286.00.
Payment of said funds will be made to the Town upon invoices
submitted to the Corporation.
2. The Corporation and the Town acknowledge that the Newcastle
Public Library Board has assessed the present and future
financial impact of Darlington construction workers and their
families on Town library services and accept the aforementioned
sum of $86,600.00 as final settlement of financial claims on
Station Account "B", save and except any claims relating to
construction of a new facility in the Courtice area.
3. The recitals mentioned in this Agreement form part of this
Agreement.

IN WITNESS WHEREOF the Corporation, the Town and the Region
have caused this Agreement to be executed by the affixing of
the corporate seals attested by the signature of their proper
officers duly authorized in that behalf.
