THE CORPORATION OF THE TOWN OF NEWCASTLE
BY-LAW 87- 19
being a By-law to amend By-law 84-63, the Comprehensive Zoning By-law of the
Corporation of the Town of Newcastle.
WHEREAS the Council of the Corporation of the Town of Newcastle deems it
advisable to amend By-law 84-63, as amended, of the Corporation of the Town of
Newcastle;
NOW THEREFORE BE IT RESOLVED that the Council of the Corporation of the Town of
Newcastle enacts as follows:
1) Section 1, Paragraph 2 is hereby amended by deleting the numeral "18" in
the 1st line and replacing same with the numeral "19".
2) Section 2 "Defi niti ons II is hereby amended by changi ng from "60 square
metresU to u50 square metresu the mi nimum floor area requirements for
uDwell i ng, Converted".
3) Section 3.l(d) is hereby amended by adding the words liar 40 percent of
the prescribed minimum floor area for a residential dwelling within the
applicable zone, whichever is greater II following the word uareau in the 3rd
1 i ne .
4) Section 3.14(a) is hereby amended by deleting the numeral u6" in the 9th
line and replacing same with the numeral "5.7", and by deleting the numeral "3"
in the 9th line and replacing same with the numeral "2.75".
5) Section 3.14(d)i) is hereby amended by deleting the numeral "9.0" in the
2nd 1 i ne and rep 1 aci ng same wi th the numeral "7.5". Sai d Secti on is hereby
further amended by inserting the words "side yard lot line" prior to the word
uboundary" in the 2nd 1 i ne and addi ng the words uor 1. 5 metres of the rear yard
lot line boundary of a Residenti al Zone" after the word uZoneu in the 3rd line.
6) Section 3.20 is hereby amended by deleting the numeral u9" in the 3rd
line and replacing same with the numeral "7.5".
7) Section 12.l(b) is hereby amended by adding the words "with an attached
garage or carport" after the word "dwelling" in the 3rd line.
8) Section 13.l(b) is hereby amended by adding the words "with an attached
garage or carport" after the word "dwellingU in the 3rd line.
9) Secti on 14.1 (b) is hereby amended by addi ng thereto the words "wi th an
attached garage or carport" after the word "dwelling in the 3rd line.
10) Sect ion 16.1 (b) i i i) is hereby amended by addi ng the words ubank or
financial establishment", prior to the word "business".
11) Section 19.3(e) is hereby amended by deleting the words liar abuts a lot
having a resi denti al use situated thereon wi thi n 15 metres of such comrron 1 at
1 i ne U .
12) Section 19.3(g) is hereby amended by deleting the words liar a lot having
a resi denti al use si tuated thereon withi n 15 metres of such comroon lot 1 ineu.
13) Section 19.3(i) is hereby amended by adding the words ufor all permitted
uses, save and except that a hotel shall not exceed a maximum height of 25
metresu.

14) Schedule "1" to By-law 84-63, as amended, is hereby amended by changing
from "Environmenta1 Protection (EP)" zone to "Residentia1 Estate Exception
(RE-4)", the lands shown on the attached Schedule "X" hereto.
15) Schedule "3" to By-law 84-63, as amended, is hereby further amended by
changing from "Special Purpose Commercial Exception (C4-1)" to liSped al Purpose
Commercial Exception (C4-5)" the zone designation of the lands so indicated on
the attached Schedul e IIX_2" hereto.
16) Schedule "3" to By-law 84-63, as amended, is hereby further amended by
changing from "Special Purpose Commercial Exception (C4-5)" to "Special Purpose
Commercial Exception (C4-1)" the zone designation of the lands so indicated on
the attached Schedule IX-2" hereto.
17) This By-law shall come into effect on the date of passing hereof subject
to the provisions of Section 34 of the Planning Act, 1983.
