THE CORPORATION OF THE TOWN OF NEWCASTLE
BY-LAW NUMBER 86- 64
being a By-law to amend By-law 75-38.
WHEREAS the Council of the Corporation of the Town of Newcastle has enacted
By-law No. 75-38, entitled "a By-law to require the Owners of outdoor
swimming pools to erect and maintain fences and gates around such swimming
pools and prescribing the height and description of and the manner of
erecting and maintaining such fences and gates".
AND WHEREAS the Council of the Corporation of the Town of Newcastle wishes to
re-assign the responsibility for enforcement of By-law 75-38;
NOW THEREFORE the Council of the Corporation of the Town of Newcastle hereby
enacts as follows:
1. Section 2, Subsection 3 of By-law 75-38 is hereby amended by deleting
the words lithe swinming pool by-law of the Corporationll and replacing same
with the words lithe Ontario Building Cade".
2. By-law 75-38 is hereby further amended by changing the numbering of
Subsections "411 and "5" to Subsections 11511 and 11611 respectively and by adding
thereto a new Subsection 11411 as follows:
(4) IIBy-law Enforcement Officerll means the Officer or employee
charged with the duty of enforcing the Swimming Pool By-law of
the Corporation.
3. Section 5, Subsection 1 of By-law 75-38 is hereby amended by deleting
the words "Building Inspectorll and replacing same with the words IIBy-law
Enforcement Offi cerll.
