THE CORPORATION OF THE TOWN OF NEWCASTLE
BY-LAW 86-61
being a by-law to authorize the execution
of a Certificate of Release with respect to
a Development Agreement between Walter
Schleiss Construction and the Corporation
of the Town of Newcastle
THE COUNCIL OF THE CORPORATION OF THE TOWN OF NEWCASTLE
HEREBY ENACTS AS FOLLOWS:
1. THAT the Mayor and Clerk are hereby authorized to execute
on behalf of the Corporation of the Town of Newcastle, and
seal with the Corporation seal, a Certificate of Release
of Development Agreement between Walter Schleiss
Construction and the Corporation of the Town of Newcastle;
2. THAT the Development Agreement referred to in Section 1
hereof, was registered as Instrument Number N20033 and the
lands referred to in the said Development Agreement were
described in Registered Plan of Subdivision No. 683.

By-law read a first and second time this 12th day of May 1986.
By-law read a third time and finally passed this 12th day of
May 1986.

THIS AGREEMENT MADE (in triplicate) this 1st day of
April, 1986.
BET WEE N
THE CORPORATION OF THE TOWN OF NEWCASTLE
hereinafter called the "Corporation"
OF THE FIRST PART
- and -
WALTER SCHLEISS CONSTRUCTION
hereinafter called the 1I0wnerll
OF THE SECOND PART
WHEREAS the Owner entered into a Subdivision
Agreement with the Corporation dated the 13th day of June,
1963 and registered in the Land Registry Office for the Land
Registry Division of Newcastle (No. 10) on the 29th day of
July, 1963 as Instrument Number N20033 which Subdivision
Agreement affects the lands moce particularly described in
Schedule "A" attached hereto;
AND WHEREAS the Owner has satisfied all the terms
and conditions contained in the said Subdivision Agreement
with respect to the property described in Schedule "A";
AND WHEREAS the Corporation has agreed to release
the Owner from the above referred to Subdivision Agreement
as same affects the lands described in Schedule "A" attached
hereto;
NOW THEREFORE in consideration of the sum of TWO
($2.00) DOLLARS now paid by the Owner to the Corporation, a
receipt of which is hereby acknowledged the Corporation does
hereby release and forever discharge the Owner, their
successors and assigns, all of the property described in
Schedule "A" attached hereto from the burden of the
hereinbefore recited Subdivision Agreement as set out in
Instrument Number N20033.

IN WITNESS WHEREOF the Corporation has hereunto
affixed its corporate seal duly attested to by the
signatures of its proper officers duly authorized in that
behalf.

SCHEDULE "A"
ALL AND SINGULAR that certain parcel or tract of land and
premises, situate, lying and being in the Town of Newcastle
in the Regional Municipality of Durham (formerly the
Township of Darlington and the Town of Bowmanville, in the
County of Durham) and Province of Ontario and being composed
of Lots numbers 29 and 30 according to Plan Number 638
registered in the Land Registry Office for the Land Registry
Division of Newcastle (No. 10) (formerly the Registry Office
for the West Riding of Durham County) at the Town of
Bowmanville in the Regional Municipality of Durham (formerly
the County of Durham) on the 20th day of July 1954.
